ORDER OF BUSINESS
POSSIBLE ELECTION FQ.R WASTEWATER FACILITIES/SERVICES FOR THE TOWN
The Town of Marana has executed an intergovernmental agreement
with Plma County to provide wastewater services. Water utility
and wastewater services would be a separate question on the
ballot. Ray Teran stated several developers are interested in
doing prlvization of wastewater facilities. Improvement
districts could be formed. The motion was made by Bill Schisler,
seconded by David Morales, and unanimously carried that the Town
Council add possible wastewater facilities on the March 29, 1988
election ballot.
APPOINTMENTS TO THE PLANNING COMMISSION
Mayor Tom Jones, with consensus of the Town Council, appointed
Ron Key, Tom A. Clark, Phyllis Farenga, and Dennis Dennison to
the Planning Commission for a term of six years, effective
November, 1987.

RESOLUTION NO, 87.14 - RELATING TO AIR QUALITY AND SUPPORT OF THE
REGIONAL CARBON MONOXIDE AIR QUALITY PLAN
The motion was made by Bill Schisler, seconded by Dan Groseclose,
and unanimously carried that the Town Council adopt Resolution
No. 87-14 - Relating to Air Quality and Support of the Regional
Carbon Monoxide Air Quality Plan.
RESOLUTION NO, 87-15 - ADOPTING THE CONCEPT OF THE TRAVEL
REDUCTION ORDINANCE
The motion was made by Tom Hum, seconded by David Morales, and
unanimously carried that the Town Council adopt Resolution No.
87-15 as amended - Adopting the Concept of the Travel Reduction
Ordinance.

$5000.00 to implement items one, two and three, page seven, from

Correction to Minutes of November 17, 1987 should read: The
motion was made by Bill schisler, seconded by David Morales, and
unanimously carried that the Town Council enact Ordinance No.
87.22 with the change as made by Council. The motion was made by
Bill Schisler, seconded by Bob M¢Crea, and unanimously carried
that the Town Council approve the Minutes of Regular Meeting,
November 3, 1987 and Minutes of Regular Meeting, November 17,
1987 as corrected.
PETITIONS AND COMMENTS
Lellant Schisler announced the Marana Avra Valley Arts Council is
displaying paintings of state artists at the Estes Elementary
Library Monday, December 7, 1987. Ora Ham spoke on the repairs
to the flag pole located at the entrance monument to the Town.
Wayne Pierri, 11451 West Grief Road read a petition from citizens
on Grief Road protesting the significant land use change by MCS.
Ray Teran presented a copy of Granite Construction Company's
Progress Schedule for Avra Valley Road.
The motion was made by Bob McCrea, seconded by Bill Schisler, and
unanimously carried that the Town Council retire to Executive
Session at 7:14 P.M.

ORDER OF BUSINESS
MERIT INCREASE - OFFICER BRUCE THOMAS
The motion was made by Bill Schisler, seconded by David Morales,
and unanimously carried that the Town Council raise Officer
Thomas from 8-C ($8.25 hr.) to 8-E ($8.85 hr.) on the Salary
Structure, effective November 22, 1987.
TANGERINE ROAD LAND FILL SIGNIFICANT LAND USE CHANGE - APPEAL
OF PLANNING COMMISSION DECISION
The Planning commission upheld the protests to the significant
land use change. George Brinsko spoke on the sand and gravel
operation at the landfill. The Council was concerned about noise,
pollution, and traffic. Michael A. Curtis spoke on behalf of Evco
Farms and Cortaro Marana Irrigation District. Tom A. Clark spoke
on the decision of the Planning Commission. The motion was made
by Bill Schisler and seconded by David Morales that the Town
Council continue this matter until next month to give Mr.
Brinsko's staff, our Town Attorney, and Mr. Curtis to come up
with some conditions that could be met; liability, performance
bond or escrow that can be handled to benefit the Town and this
brought back to the Council for their consideration and the Town
Council furnish Mr. Brinsko with a list of the conditions that
the Council is concerned about. The vote was five ayes. Bob
McCrea voted nay, Motion carried.

MARANA/ORO VALLEY JOINT COMMUNICATIONS SYSTEM
Ray Teran submitted one time equipment costs ($44,200.00) for the
Joint communication system. Ray Teran submitted sources of
revenue for the equipment purchases. Chief Radcliffe submitted
proposed pay scale for dispatchers for the new communication
system with Oro Valley. The cost for communications will be
$ 38,833.00 plus an additional cost of $ 2,324.32 for computer
entry and retrieval services. Chief Wolfe elaborated on the new
system. The motion was made by Hill schisler, seconded by David
Morales, and unanimously carried that the Town Council direct the
staff to prepare an Intergovernmental Agreement with firm
figures; the intergovernmental agreement being prepared by the
two Town Attorneys. The motion was made by gill Schisler,
seconded by Ora Ham, and unanimously carried that the Town
Council direct the Town Manager to implement the process for a
contract amendment to the Community Development Block Grant
Program.
FOUNDER'S DAY
Ora Ham gave an update on the parade, fair, and V.I.P.'s
activities. Bob McCrea spoke on the park activities. Jack Fisher
announced the Parade Committee would be meeting December 3, 1987
at the Sky Rider Coffee shop.

ORDINANCE NO. 87.23 - ANNEXATION FEES
Proposed annexations cost the Town some engineering fees,
attorney fees, publishing fees, and the Town Manager's time. The
motion was made by Hill Schisler, seconded by David Morales, and
unanimously carried that the Town Council adopt Ordinance No.
87.23 - Providing for the Payment of Fees to Offset the Costs of
Annexation Proceedings.
GROWTH ISSUES - ADVISORY ELECTION
The motion was made by David Morales and seconded by Ora Ham
that the issue of continued annexations by the Town of Marana be
submitted to the voters of the Town of Marana at an advisory
election to be held on March 29, 1988. The vote was five ayes,
Bob McCrea abstained. Motion carried.
DEVELOPMENT CODE CHANGES - MOBILE HOME SKIRTING REGULATIONS
The Council discussed mo~ile, manufactured homes and units. A
Public Nearing will be scheduled to discuss the skirting
regulations. The defendants that were cited for skirting
violations previously are to be notified of the Public Hearing on
Mobile Home Skirting Regulations.

the Marana Estates sub-division. John Moffitt, Town Attorney,
stated he was at a Nuca Conference in San Francisco and was

approached by a Boston delegate regarding the Town of Marana
fiber optic ordinance. Mayor Tom Jones read a statement that will
be released to the press November 4, 1987. After Mayor Tom Jones
read his statement Bruce Dewey, 14520 West Marana Road stated he
was not an outsider, rather a citizen ef the Town.
Ray Teran, Town Manager, briefly reviewed the Marana Town Hall
Meeting agenda. All delegates were mailed the issue papers
October 31, 1987.
Ora Harn and Bob McCrea mubmitted a progrems report on Marana
Founder's Cc,mmittee. Ora Ha'rn spoke on 'the various activities

that is planned after the parade.

Dan Groseclose and seconded by Bill Schisler to amend the motion
to include Section 08.02 relating to the adoption of the Uniform
Building, Plumbling and Electrical Codes with exceptions. The
vote was six ayes. Bob McCrea voted nay. Motion carried.

Frank Briggs filed a formal grievance against his su-spension. Ray
Teran filed a Notice of Intent to Terminate Frank Briggs on the
grounds of theft of Town prc, perty. Frank Briggs filed a letter
~tating that the allegations were nc, t true~ Chief Lynn Radcliffe
stated the Fz, l~ce Department had a goc, d ca~e against Frank
Briggs. The motion was made by Dan Groseclose, seconded by Bill
Schiller, and unanimously carried that the Town Council end
discussion on the grievance filed.

and unanimously carried that the Town Council terminate Frank
Briggs~ effective immediately for cauee.

McCrea announced the Marana Founder's Committee is meeting each

Robert Patrick, W.F. Conelly Profit Sharing Trust, presented an
outline for the proposed use of the Si 1 verbel 1-Linda Vista
property. Future land uses appear to be consistent with the
Continental Ranch ..... mmunity Plan and the Marana General Plan. The
motion was made by Bill Schisler, seconded by David Morales, and
unanimously carried that the Town Council direct the Town Manager
to proceed with the process of annexing the W.F. Conelly Profit
Sharing Trust property as designated by the legal description of
the property.
The Council discussed the major group level under Significant
Change in Land Use. The Council discussed Notification of
Intended Land Use Change. The Council discussed decision by the
Planning Commission. Building permits were discussed. The motion
was made by Dan Groseclose and seconded by David Morales that the
Town Council recess for five minutes. Dan Groseclose and David
Morales voted aye. Mayor Tom Jones, Bob McCrea, Tom Mum, Ora
Harn and Bill Schisler voted nay. Motion failed. The Council
discussed the Uniform Building, Plumbling and Electrical Codes.
The motion was made by Bill Schisler , seconded by Bob McCrea,
and unanimously carried that the Town Council ask the Town
Manager to work with the inspector to obtain information that
would be precluded from repairs. The Council discussed height of
building and structures. Set-backs were discussed. The motion was
made by David Morales and seconded by Bill Schisler to adopt
Ordinance No. 87.21 with modifications to two digits, remove all
reference excluding 08.01, 08.02, Section 08.03.01 and Section
05.03.01. All seven Councilmembers voted nay. Motion failed. The
motion was made by Bob McCrea, seconded by Ora Harn, and
unanimously carried that the Town Council table Ordinance No.
87.21 - Changes to the Town Development Code.

meeting the first Tuesday evening of the month. Dan Groseclose
announced the Marana 4-H and F.F.A. will hold a country fair
October 10, 1987 at the Avra Valley Airport. Ora Ham spoke on
the condition of the flag pole at the Monument entrance to
Marana.

Andrew Federhar, Chairman State Transportation Board, outlined
steps that the community must deal effectively in order to solve
air quality problems. Mr. Federhar gave a brief background on the
persons that have been nominated to serve on the Committee. Mayor
Tom Jones appointed John Paddock as Marana's representative on
the Pima County Citizen's Air Quality Committee. The motion was
made by Bill Schisler, seconded by Bob McCrea, and unanimously
carried that the Town Council endorse the Pima County Citizen's
Air Quality Committee and the Committee's goals with John Paddock
as the Citizen's representative for Marana.

Ray Teran submitted a summary of the research that has been done
on Orier Road. Robert ]ondlt, Cortaro Water User's Association,
admitted water was leaking at one seam in the pipe. Community
Development Block Grant Funds are available to repair but must
deal with the moisture causing deterioration of the subgrade on
Grief Road. The motion was made by Bill Schisler, seconded by
David Morales, and unanimously carried that the Town C:ouncil, in
conjunction with Cortaro's repairs to the irrigation pipe along
Grief Road going to the school, direct the Town Manager and the
Road Supervisor to wc, rk directly with Cc, rtaro as soon as possible
and report to the Town Council if there is any problem with the
repair s.

the proposal was very expensive. The motion was made by Bill
Schisler, seconded by David Morales, and unanimously carried that
the Town Council direct the Town Manager to prepare a request for
proposals for water utility election consultant.

Advisory Committee - Citizen Representative: Mayor Tom Jones
asked Council to submit names for a Citizen Representative. Item
to be placed on October 20, 1987 agenda.
2. City of Tucson - Pisa County - Executive Air Quality
Committee, Elected Official Representative - Mayor Tom Jones will
serve on the Executive Air Quality Committee.

Mayor Tom Jones will contact the citizens that did attend the
previous meetings in order to re-activate the Committee. The
Committee will prepare materials for the water utility election.

and unanimously carried that the Town Council adopt Ordinance No.
87. 19 - Paddock Property Annexation.
The motion was made by Bill Schisler, seconded by David Morales,
and unanimously carried that the Town Council adopt Ordinance No,
87.20 - The Call For And Holding Of A Referendum And Initative
Election.
The present coverage for employee's health insurance, Principal
Company, has raised rates between 30 and 40 percent. Time
Insurance Company quoated the Town a 3 to 5 percent increase. The
motion was made by Bill Schisler~ seconded by David Morales, and
unanimously carried that the Town Council direct the Town Manager
to draw up necessary documentation to provide health care
insurance by the Time Company.

David Morales stated he felt the citizens of Marana needed to be
more informed ofboun,.~- -'ll meetings. The motion was made by David
Morales and seconded by Bill Schiller that in addition to the
posting of agendas in existing locations Kenny's Market, Circle
K~ Marana Auto Parts and Marana Hardware be added providing the
businesses do not object. The vote was six ayes. Dan ~ -
voted nay. Motion carried.
Bilby and Shoenhair~ Attorneys, submitted a draft of Memorandum
of Agreement proposed to be entered into with Pima County~
Department of Transportation and the Town of Marana. Ray Teran
submitted a memorandum regarding land purchase coordination for
flood control and protection. John Moffitt submitted an addendum
to Memorandum of Agreement. Mayor Tom Jones spoke on land
acquisition and Marana entering into an intergovernmental
agreement on flood control with Pima County Floodway and flood-
plain were discussed. The purchase of flood-prone land was
discussed. The consensus of the Council was to act as an agent
for Pima County in land acquisition. Consensus of the Council was
to work with Pima County on an intergovernmental agreement on
flood control. The concept of the agreement was approved by
consensus of the Council.
Mayor Tom Jones stated the following reasons Pima County would
like to purchase the ranches:
i. to preserve an area for environmental purposes
2. access to underground water
3. to sell part of the ranch to finance the cost
4. Pima County would like to construct a park
The motion was made by Dan Groseclose, seconded by David Morales
and unanimously carried that the Town Council direct the Mayor to
write a letter to the County Board of Supervisors expressing our
concerns and to re-consider their thoughts regarding the purchase
of the ranches.

David Morales declared conflict of interest on aerial spraying.
Joe Parsons, 13580 West Kirby Hughes Road, spoke against
pesticides being sprayed on his property, low flying air craft,
and noise pollution. Tom Glarer, Glover Ranch, stated he was
governed by the F.F.A. and Arizona Commission of Agriculture and
Horticulture. Buffer zones are established for school, day care
centers, health care centers, and residential area. Pesticide
reports must be filed with Arizona Conunission of Agriculture and
Horticulture. Tom Olover stated the air-strip on Wentz Road will
be moved to the Wang property on North Sanders Road. Bill
Klndall, Arizona Commission of Agriculture and Horticulture spoke
on the monitoring of pesticides. Stan Gladden, Moore Road and Tom
Clark, Barnett Road spoke in favor of safe pesticides. Cheryl
Boone, 13600 West Kirby Hughes Road, stated she and her horse
were sprayed with pesticides by low flying planes. If any
citizens have problems with spraying, low flying planes, or noise
pollution Tom Glarer will cooperate.

David Morales stated the Price Lane area was used as a prisoner's
camp during World War II. The motion wes made by Ora Ham,
seconded by Savid Mozales, and unanimously carried that the Town
Council direct the Town Manager to contact Pima County Wastewater
Management asking them to monitor the old Marana Landfill and the
Price Lane area, with a copy to the Soa~d of Supervisors.

KCS LICENSE AGREEMENT
David Morales declared conflict of interest. John Moffltt stated
two areas of the Cable Communications system r.icense should be
changed. Gary Davidsonf MCS~ agreed to the chanqes. A new
agreement will be worked out between John Noffitt and Gary
Davidson. The motion was mede by Ora Harn; seconded by Bob
McCrea, and unanimously carried that the ?own Council accept the
Cable Communications System r.icense with modifications. ?he

the i~ues that are needed to form ~ Municipal Property
Corporation and what the Corporation may do. The Corporation must
have t~ree to five members who are the Board of Directors. The
Corporation can finance capital improvement programs and retain
general bonding programs. A bond attorney and a f~nancial are
necessary to proceed with financing issues. The motion was made
by Bill Schisler, seconded by David Morales, and unanimously
carried that the Town Council direct the Town Manager to seek
professional help to form a Municipal Property Corporation.

The model tax code as presented was developed by the League of
Arizona Cities and Towns for all Municipalities. The consensus of
the Council was that personal services should not be taxed.
Utility services should be taxed at 4%. Ray Teran will contact
the League to make the changes. The motion was made by David

the Town Council table Resolution No. 87-10 Town Tax Code and
Ordinance No 87.10 Town Tax Code.

No. 87-09 - for Reserve Police Officers.
Ray Teran submitted an agreement allowing Pima County to manage
and implement the Community Development Block Grant Program. The
motion was made by Bill Schisler and seconded by David Morales to
direct the Mayor to sign the agreement with Pima County for
Community Development Block Grant Funds. The vote was five ayes.

Ray Teran submitted a memorandum of the status of Marana Park
including Fiscal Year 1985-86 expenditures and revenues. John
Mof fitt, Town Attorney, submitted opinions on the proposed
transfer of Pima County Park to the Town. Mayc, r Tom Jones and Ray
Teran will meet with Jim Riley, Pima County Manager, to discuss
t~e issue further.
Ray Teran submitted comments on the proposed Floodway
Intergovernmental Agreement with Pima County. (Copy in ~ile).
Charles Huckelberry, Assistant County Manager submitted key area
of difference in the Marana ordinance. T~ese di fferences must be
brought into conformance with the Floedplain Management Ordinance
of Pima County. Ray Teran will meet with Charles Huckelberry to
try and resolve t~e issues in the c, rdinance.
Mayor Tom Jones, Mr. Bob McCrea, Mr. Ray Coleman and Mr. Ray
Teran rated the consultants interviewed. ]'he three consultants
were Hugh Holub; Mallory, Jones and Donahue; Narza Engineering.

Town c,f Marana. The vote was five aye. Mayor Tom Jones voted nay.

Arizona Department of Transportation submitted the proposed
Intergovernmental Agreement covering the const ruc t i c,n,
maintenance and financing of Avra Valley Road. The estimated cost
of overlay of existing pavement is $ 460,0B2.00. T~e Town's funds
is $ 43,800.00. Ray Coleman suggested additional language to the
document which is to be added. (Copy in file). The motion was
made by Bill Schisler and seconded by David Morales to direct
Mayor Tom Jones tc, sign the Intergovernmental ~greement with the
Arizona Department of Transportation, pending legal approval by
the Town Attorney, and direct the Town Manager to bc, rrow the
matching funds from a financial institution offering the best
interest rate. The vote was five aye. Bob McCrea voted nay.

Major Russell Davis, Pima County Sheriff's Department, stated
that the Town of Marana should pay for the housing of prisoners.
The City of Tucson and South Tucson have signed an
Intergovernmental Agreement with Pima County for housing of
prisoners. John Moffitt, Town Attorney, readA.R.S. Section 31-
121 which provides that the Sheriff shall receive all persons
committed to Jail. John Moffitt will discuss the housing of
prisoners with the legal counsel of the City of Tucson and South
Tucson. John Moffitt will discuss the Intergovernmental Agreement
with Michael P. Callahan, Deputy Pima County Attorney.

PROPOSED FISCAL YEAR 1987 -88 BUDGET
Ray Teran submitted a proposed budget for Fiscal Year 1987 -88 as
recommended by the Budget Committee. Projected revenues were
discussed. Expenditures (based on 2.5% Salary Adjustment) were
discussed. Administration proposed budget was discussed. Ray
Teran stated the Development Services Department is a proposal
for a new department within the Town structure. Judge George
Kline addressed the Council stating that S 500.00 needed to be
added to the Municipal Court Budget in order to purchase two
computer programs. Ray Teran recommended that two police officers
be hired in the next fiscal year. The consensus of the Council

• was that more officers are needed. The Streets and Roads budget

Department, Inc. has purchased a 1979 Ford 3/4 T. ambulance. The
Marana Volunteer Fire Department, Inc. will hold a meeting
Wednesday, June 3, 1987 to discuss the Fourth of July
celebration.

unanimously carried that the Town Council hold a Public Hearing
on Acacia Hills (Estes Company) proposed annexation.

Jon Schladweiler submitted a map of the area from Ina Road to the
area north of Marana. Acacia Hills is tributary to the
Continental Ranch Wastewater pumping facility. The County has
awarded a bid for construction of a sanitary sewer crossing of
the Santa Cruz River. M.S.P. Company currently has a design for a
proposed Marana south sewage treatment facility. The County is
working with White Farms proJect to service that area. The ponds
now in use might be enlarged. New sites are being studied in
order to bring a treatment facility to the north of Marana. The
flood plain remains an issue in selecting sites for a treatment
facility.

regards to "Action Arizona" projects. Asked Emma Waples to

Mutual Annexation Issues with Other Cities
Marana and Oro Valley discuss annexation issues that are of
mutual interest. Marana does not solicit persons to annex to the
Town. Marana and Tucson have not had any discussions. Mayor Bill
Schisler may talk to Bill Ealy at a future date.

The Council discussed the amount of hours the Town Attorney is
providing the Town each month. The proposed contract for Town
Attorney - July 1, 1985 through June 30, 1987 and proposed
contract for July 1, 1987 through June 30, 1989. Ray Teran will
contact several attorneys to determine a base monthly retainer of
15 hours and the amount of each hour in excess of 15 hours per
month.

The Council discussed the Sign Code. The required signs is to be
changed on the adopted Sign Code. Fees will be changed on the
adopted Sign Code as suggested by the Town Council. The motion
was made by Tom Jones and seconded by Ora Harn that the Town
Council adopt the Sign Code with changes. The vote was four ayes.

recreational or scientific facilities or programs, or for non-
residential out patient programs or services for developmentally
disabled persons.

with a salary of $ 11.08 per hour. The vote was three ayes. Dan
Groseclose, Tom Clark, and Bill Schisler voted nay. Tie vote.
Motion failed.

Doug Noll, Estes Company, presented maps showing the proposed
annexation of Acacia Hills property and 2000 acres of state land.
The Arizona State Selection Board approved the 2000 acres for
annexation April 21, 1987. Doug Noll submitted an economic impact
analysis for the Acacia Hills proposed annexation. The motion
was made by Ora Harn, seconded by Tom Jones, and unanimously
carried that the Town Council direct the Town Manager to proceed
with Step One of the annexation petition for Acacia Hills.

Henley and Charlie Vega spoke in favor of the liquor application.

contractor agrees to remove all but the bottom nine feet of all
trees and related vegetation. The contractor must have general
liability coverage in the amount of $ 500,000.00 or furnish a
bond in the amount of $ 500,000.00. The motion was made by Bob
McCrea and seconded by Ora Harn to authorize the Mayor to sign
the services contract with Pima Tree Service for tree related
work in Yoem Pueblo. The vote was five ayes. Dan Groseclose and
Torn Jones voted nay. Motion carried.
Fiscal Year 1987 -88 Budget Adapticn
The ballot format for the alternative local expenditure
limitation states that by June 30 of each year an ordinance must
be adopted for expenditure limitation. Ray Teran furnished a
copy of the proposed meetings that the Council may discuss the
1987 -88 Budget.

The Development Code will be placed on the Planning Commission

floodplain in the Town limits of Marana. Tom Jones stated he
felt an intergovernmental agreement was necessary with Pima
County to insure bank protection on the Santa Cruz River between
Avra Valley Road and the Pinal County line. Ray Teran will
contact Pima County Flood Control District to obtain a copy of
the proposed agreement between Pima County and the Town of
Marana. Item will be placed on future agenda.

John R. Moffitt submitted correspondence from Ensearch
Corporation attorney, Bureau of Reclamation, and excavation
permit. The permit fee was not included in the contract between
the Bureau of Reclamation and Ensearch Alaska Corporation. Will
Worthington, Bureau of Reclamation stated the Bureau of
Reclamation was willing to pay the Town any additional costs that
the Town has incurred due to the Central Arizona Project. The
motion was made by Tom Clark, seconded by Ora Harn, and
unanimously carried that the Town Council compile and review the
actual costs of inspections for the Central Arizona Project work
within the Town limits of Marana and bill the Bureau of
Reclamation.
Discussion - New Town Hall
Ray Teran submitted Scope of Work, as prepared by David C.
Grigsby, Director of Architecture at F. and D. Associates, to
identify possible solutions to meeting the functional and space
requirements of the Marana Town Hall. After discussion the
consensus of the Town Council was that Ray Teran, Ray Coleman,
and David Grigsby would meet and discuss plans for Town Hall.

Ray Teran submitted a graphic design - client agreement from the
University of Arizona Art Department. The art class will provide
different logos and will also do a "corporate" image package for
each logo. The Town will need to donate $ 250.00 to the
University of Arizona Foundation Scholorship Fund. The agreement
is to be amended as follows:
Item 2 - Client will be sole selector of the winning design.
Item 4 - Client will approve all additional costs prior to the
incurred costs.
Item 6 - Client will be allowed to use the project results at no
charge now or in the future.

and public enities. The Planning Center distributed a revised
draft of the General Plan. The Plan will be studied and another
workshop will be held with the Town Council and the Planning
Commission.

unanimously carried that the Town Council call a Special Meeting
March 18, 1987 at 5:00 P.M. for the purpose of a Public Hearing
for Amcor Annexation.
R.E. Mi - Appeal of Planning Cm
omission
Decision: Ray Teran furnished a calendar of events since the R.E.
Miller Company sent letters notifying property owners of a lard
use change in the Town. Tom Clark spoke on his concerns related
to potential flooding problems within the Santa Cruz River. Tom
Jones spoke on bank protection of the Santa Cruz River. The
motion was made by Tom Clark, seconded by Bob McCrea, and
unanimously carried that R.E. Miller Company and Evco Farms, Inc.
be allowed to make comments. Steve Simpson, R.E. Miller Company,
stated that the Town should decide if s properly operated sand
and gravel operation should be permitted in the Town and once the
sand and gravel operation is a permitted use, then the issue of
flooding should be addressed. Art Pacheco, Evco Farms, Inc., read
his letter of protest dated December 29, 1986. (Copy in file).
The Planning Commission's decision was to uphold the protest and
deny the significant land use change for R.E. Miller Company.
The motion was made by Tom Clark, seconded by Bob McCrea, and
unanimously carried that the Town Council uphold the decision of
the Planning Commission and deny the significant land use change.
Resolution No. 87 -03 - Moore Road - I-10 Interchange
The motion was made by Tom Clark, seconded by David Anway, and
unanimously carried that the Town Council adopt Resolution No.
87 -03 - Requesting a traffic interchange at the Moore Road
alignment and Interstate 10.

Bob McCrea stated his concerns about eye protection and helmets
for persons riding motorcycles in the Town. Bob McCrea stated he
had been told that all terrain vehicles would soon be seen in the
Town and that they would cause dust pollution. A.T.V. were
discussed by the Council. The motion was made by Bob McCrea and
seconded by Tom Clark to instruct the Town Attorney to prepare an
ordinance requiring children under eighteen years of age be
required to wear a helmet and eye protection in the Town of
Marana. The vote was four ayes. Tam Janes and Dan Groseclose
voted nay. Motion carried.

unanimously carried that the Town Council adopt Resolution No.

The Council discussed the Flood Damage Prevention Ordinance. Ray
Coleman questioned certification by a registered architect of
areas located within special flood hazard areas. The word
architect is to be deleted from Section 5.6 Floodways, under Sub-
section A. (page 19). The motion was made by Tom Clark, seconded
by Ora Harn, and unanimously carried that the Town Council adopt
Ordinance No. 87.0E - Floodplain Management and instruct the Town
Manager to strike the word architect in the area of Flood -way.
(Section 5.6 Floodways).
Intgrgov- ernmental Agreement with Pima County for Street Numbering
Pima County submitted a draft intergovernmental agreement for
services in street naming and addressing related activities. The
Council discussed street naming, duplication of street names and
emergency vehicle response. The consensus of the Council was
that the Planning and Zoning Administrator could coordinate
street names and numbering.
NEW BUSINESS
Flaod_way Management Resgonaibility
Pima County was to furnish a draft agreement for the Council to
review. The consensus of the Council was that Pima County should
administer the flood -way of the Santa Cruz River and the Town
• should administer the flood -plain in the Town limits.
Unauthorized Sand and Gravel Operation at Pima County j
Pima County has excavated -a new cell for the landfill. Pima
County is planning to allow a private company to operate a sand
and gravel operation. Pima County has not requested a
significant land use change. Ray Teran will notify Pima County
that they must comply with the Development Code of the Town.

August. Mayor Schisler appointed the following persons to the

Ray Teran suggested that the Council begin a public participation
process before calling a utility election. John Moffitt
explained the time frame for an election. Tom Jones suggested e
Blue Ribbon Committee be formed to educate the citizens regarding
the flown being in the utility business. The motion was made by
Tom Jones, seconded by Bob McCrea and unanimously carried that
the Town Council authorize the Mayor with the Council's voting
consent, to appoint a Blue Ribbon Task Force, citizens of the
Town of Marana, for the purpose of making recommendations to the
Council regarding election to establish water and waste water in
the Town of Marana.

Ray Teran submitted Water Utility Consultant standards and
specifications. Ray Teran submitted a proposal for water utility
consultant to be published February 24, 25, 26, 27, 1987 in the
Territorial newspaper. The consensus of the Council was to
direct Ray Teran to publish the water utility consultant
proposal.
Financial Procedures
Ray Teran submitted proposed Financial Management System. Ray
Teran and Town Attorney will discuss the proposed Financial
System and then Ray Teran will submit the final draft to the
Council for action.
PY_ -Laws for the Town Council
Mayor Bill Schisler will present draft of By -Laws at the March 3,
1987 Council meeting.
Needs and Options for a Town Complex
Ray Teran spoke on the future needs of the Town Council and the
staff.
Some of the options discussed were:

PETITIONS AND COMMENTS
Chief William M. Gaudette announced that the Fire Department
would hold a meeting February 17, 1987 at 7 :00 P.M. to discuss
the Second Annual July 4th celebration. Chief Gaudette stated
that Ted DeSpain had donated a tanker- trailer to the Fire
Department and Blue Circle had donated a tractor.

Ray Teran submitted a list of projects that were proposed at the

2. Apply for $50,000.00 of Pima County Block Grant Funds to be

1987) to submit a detailed site specific plan for 494 acres. The

1.0 Introduction & Preparation
1.1 Reason for the meeting is because we are at a critical point in the
decision of utility service.
1.2 Election required before we enter utility service so we must
prepare.
1.3 General plan comments have been general in nature, but future
approaches by developers will need to be carefully judged to see if
they are compatible with the town's agenda or goals.
1.4 Public hearings for annexations will soon find ideas negative to the

1.5 Need to talk up front with developers rather than construct hurdles
for them to pass over to qualify so they may be part of the com-
munity. Later on the hurdle process may be needed just for control.
1.6 Tom Jones suggested that it would be well to employ, on a consultant

1.7 R. Teran will suggest at budget time that the Town staff will be so
reinforced so that staff can move toward the implementation of the

2.1 C.A.P. Water may be obtained at cost of $35 /AC ft. which is just

2.2 If you have a C.A.P. allocation, you do not have to prove a 100 -year
adequacy, which is good until about 2010.
2.3 Agr. water can be contracted for from C.A.P. at 3 ac ft /year /AC; but
if land is converted to residential, then this area can only use 1

4.1 Cottonwood Properties - George Mehal
4.1.1 Property about 5 -6 miles east of Marana town limits. Now
called Tortillita Foothills - 5500 acres.

4.1.2 Hotel property now under design. " Architect, employed and
under way. 75 to 100 million dollar facility, 700 to 800
people employed. Time table now sees opening 1990 with golf
course, etc.
4.1.3 Community outside - low density residential with some
research park facilities. Very high level of planning is key
to the development. Hope to influence what happens around
them. Quality implies sense of planning not expensive.
4.1.4 Concept of plan is Village Nodes which fits Marana's General
Plan. Allows a sense of identity to those who reside in or
adjacent to 35% open space in the project.
4.1.5 If they are annexed into Marana, they would no doubt be the
first submission of the specific plan and would push for this
to happen.
4.1.6 Water presently two miles away from development. They think
they will be moving too fast for Marana to be 'able to serve.
Also will be seeking sewer service from county, and again
Marana would be developing their sewer service posture to
slow to serve this project.
4.1.7 They will have 3 Village Cores with small shopping centers,
small shops, some school facilities, some Fire and Police
facilites.
4.1.8 They would impact Marana positively with regards to tax
income. They would realize speed of the development process
and enjoy the philosophy of allowing the private firm to move
• with the minimum of impediments.
Also, they will benefit from the amount of planning Marana
has done.
4.1.9 Marana should show State Land Department what their plans are
with a formal presentation. State Land Department must sell
the land to obtain highest and most 'value for the state.
4.1.10 They do have reservations as to whether Marana can handle
Cottonwood's development, but they will bring a lot of
resources to the Town, and they do need to make sure that
things will come to fruition.
4.2 Estes Company - Acacia Hills - Doug Knoll
4.2.1 Most interested because:
a. Planning has been done.
b. It appears that time can be a big factor, as it seems
that development could happen quickly.
4.2.2 Master Plan Committed - Environmental completed. They are
ready to go for re- zoning before Board of Supervisors.
4.2.3 Acacia Hills, 800 acres - Also has lease on 2000 acres of
state land north of Acacia.
4.2.4 Concept is a middle income master plan for residential

Interchange.
4.2.5 Will need to cooperate with property to southwest, between
Acacia and I -10, to accommodate the drainage scheme.
4.2.6 Looking for 3000 to 4000 units on the 800 acres. They do not
build anything (Estes Development). They bring the land to a
point of being ready to build on then create the CCRS and
sell to builders. They would like 1st model homes in place
1st quarter of 1988. City of Tucson should be digging wells
within next six weeks. They have a sewer service agreement
worked out with Pima County. Sometime this year they will
start building roads.
4.2.7 Estes have Type II water service permits. They plan to deed
these over to City of Tucson who will then dig the wells and
do a hydrologic study to determine the water adequacy. They
also will bring in water infrastructures possibly from Avra
Valley.
4.2.8 They have an open mind if Cortaro would offer to serve water
to the area. They passed out a small size plan document.
4.2.9 Pima County has just recently shown a great deal of interest
in this development. He gave an example of a six lot devel-
opment in Ventana Canyon that is in the seventh month of the
Pima County approval process.
4.3 La Reserve Project, 1200 acres, 1 to 14 acres home sites.
4.3.1 On the 2000 acres of state land they have a planning right
. only. If they plan it correct or right, they will be the
only ones who may be able to purchase it.
4.3.2 They have been approached by M.S.P. for sewer service treat-
ment. County has told them that they have to deliver sewer
service to county facilities before they get their plans
approved period.
4.3.3 How do they get coordinated into the general plan of Marana?
They were told to provide their information to our planners.
