A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA,
REI.EASING THE ASSLrRANCE AGREEMENT (TRUST NO. 10,464) FOR SOMBRERO PEAK
ESTATES LOTS 1 THROUGH 77 AND ACCEPTANCE OF PUBLIC IMPROVEMENTS
LOCATED IN SOMBRERO PEAK ESTATES FOR MAINTENANCE.
WHEREAS, a request for the release of the Assurance Agreement for Completion of Public
Improvements (Trust No. 10,464) for Sombrero Peak Estates to KYS Investment Company, Inc. and
C & C Construction Company for lots 1 through 77, has been presented to the Town of Marana for
approval; and
WHEREAS, the acceptance for maintenance of 1.5 miles of paved streets in the subdivisions
known as Sombrero Peak Drive, Wade Springs Drive, Quail Ridge Drive and Wade View Drive, has
been presented to the Town of Marana for approval; and
WHEREAS, the acceptance for maintenance of improvements in the public right-of-way,
survey monuments 43 and miscellaneous items such as regulatory traffic control signals and street
signs, has been presented to the Town of Marana for approval; and
WHEREAS, the release l~om the Assurance Agreement and the acceptance for maintenance
of the public improvements in Sombrero Peak Estates would be in the best interest of the citizens of
the Town of Marana.
NOW, TI4F~REFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana
that the Assurance Agreement for Completion of Subdivision Improvements (Trust No. 10,464), in
Sombrero Peak Estates is released to KYS Investment Company, Inc. and C & C Construction
Company for lots 1 through 77 of Sombrero Peak Estates and maintenance of the public
improvements as stated above in Sombrero Peak Estates is accepted into the Town of Marana
maintenance system.
