A RESOLUTION OF THE MAYOR AND COUNCIl'. OF THE TOWN OF MARANA, ARIZONA,
ABANDONING PORTIONS OF A 20-FOOT ROADWAY AND UTILITY EASEMENT IN THE
VISTA DE LAS MONTAiqAS WHICH ARE NO LONGER NECESSARY FOR TOWN USE.
WHEREAS, an application for abandonment of portions of a 20-foot roadway and utility
easement has been submitted to the town by an abutting land owner; and
WHEREAS, the Mayor and Council have the authority pursuant to A.R.S. § 9-240(B)(3)(e)
to abandon easements which are no longer necessary; and
WHEREAS, it has been determined by the Mayor and Council that those portions of the 20-
foot roadway and utility easement as it traverses lots 17 through 25 of the Clark's Vista de las
Montafias are no longer necessary to the town, notice of the intended abandonment has been posted
on the property and sent to adjoining property owners and published and the Mayor and Council has
determined that the land is of no monetary value due to its location and degree of fragmentation.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of
Marana, Arizona that the Town of Marana abandon those portions of the 20-foot roadway and utility
easement as it traverses lots 17 through 25 of the Clark's Vista de las Montafias, as more fully
depicted in the map attached hereto as exhibit A and incorporated herein by this reference, that are
no longer necessary to the town, subject to the following conditions:
1. Approval of the abandonment by potemially affected utility companies.
The abandonment does not land-lock any property owner and no objection to the
abandonment is received from property owners to the Public Works Department of the Town
of Marana by March 7, 1996.
