Regular Council meetings are usually held the first and third Tuesday of each month at 7:00 p.m. at the Marana Town Hall, although the date or time may change, or Special Meetings may be called at other times and/or places. Contact Town Hall or watch for posted agendas for other meetings. This agenda may be revised up to 24 hours prior to the meeting. In such a case a new agenda will be posted in place of this agenda. If you are interested in speaking to the Council during Call to the Public, Public Hearings, or other agenda items, you must fill out a speaker card (located in the lobby outside the Council Chambers) and deliver it to the Town Clerk prior to the convening of the meeting. All persons attending the Council meeting, whether speaking to the Council or not, are expected to observe the Council Rules, as well as the rules of politeness, propriety, decorum and good conduct. Any person interfering with the meeting in any way, or acting rudely or loudly will be removed from the meeting and will not be allowed to return. To better serve the citizens of Marana and others attending our meetings, the Council Chambers are wheelchair and handicapped accessible. Any person who, by reason of any disability, is in need of special services as a result of their disability, such as assistive listening devices, agenda materials printed in Braille or large print, a signer for the hearing impaired, etc., will be accommodated, Such special services are available upon prior request to the Town Clerk at least 10 working days prior to the Council meeting. ADJOURNMENT 1~W N ~F TOWN COUNCIL MEETING TOWN OF MARANA 9 ' nr~,aNA ; INFORMATION gR~2UNP MEETING DATE: Apri129, 2008 AGENDA ITEM: E. 1 TO: MAYOR AND COUNCIL FROM: Michael Reuwsaat, Town Manager SUBJECT: Resolution 2008-57: Relating to the Police Department; providing for the appointment of Terry Tometich as Interim Chief of Police; and declaring an emergency. DISCUSSION The purpose of this item is to request the Town Council's approval of my recommendation to appoint Mr. Terry Tometich as Interim Chief of Police in accordance with Section 4-1-2 of the Marana Town Code. This appointment shall be effective April 30, 2008, pursuant to the terms and conditions outlined in the attached Offer Letter. Mr. Tometich is a Marana resident who retired from the Arizona Department of Public Safety after a distinguished career that spanned over 31 years and encompassed all aspects of police work. During the last six years of his career, Mr. Tometich served as the Southern Region Bureau Chief/Commander, a position with oversight for all operations of the DPS for an eight- county region, covering over 38,000 square miles, which included Arizona's border with Mexico. Mr. Tometich's experience and expertise will be invaluable in assisting the Marana Police Department during this transition. During the next six months, the Town will initiate a competitive search process to select the successor to Chief Vidaurri. ATTACHMENTS Offer Letter RECOMMENDATION Staff recommends appointment of Terry Tometich to the position of Interim Chief of Police pursuant to the terms and conditions outlined in the attached Offer Letter. SUGGESTED MOTION I move to adopt Resolution 2008-57. {oooo8v47.DOC/}. 04/28/2008 9:23 a.m. MARANA RESOLUTION N0.2008-57 RELATING TO THE POLICE DEPARTMENT; PROVIDING FOR THE APPOINTMENT OF TERRY TOMETICH AS INTERIM CHIEF OF POLICE; AND DECLARING AN EMERGENCY. WHEREAS Marana Police Department Chief of Police Richard Vidaurri has announced his intention to retire no later than June 30, 2008; and WHEREAS Marana Town Code Section 4-1-2 provides that the chief of police shall be appointed by the Town Council upon the recommendation of the Town Manager; and WHEREAS Terry Tometich is a Marana resident who retired from the Arizona Department of Public Safety after a distinguished career that spanned over 31 years and encompassed all aspects of police work, including serving as the Southern Region Bureau Chief/Commander for the last six years of his career; and WHEREAS the Town Manager recommends Terry Tometich's appointment to the position of Interim Chief of Police of the Marana Police Department; and WHEREAS the Town Council finds the appointment of an Interim Chief of Police to be in the best interests of the Town. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, that Terry Tometich is hereby appointed Interim Chief of Police of the Marana Police Department pursuant to the terms and conditions outlined in the Offer Letter, attached to and incorporated by this reference in this resolution as Exhibit A. BE IT FURTHER RESOLVED that since it is necessary for the preservation of the peace, health and safety of the Town of Marana that this resolution become immediately effective, an emergency is hereby declared to exist, and this resolution shall be effective immediately upon its passage and adoption. Coyote Gulch Loop Marana, AZ 85658 Dear Mr. Tometich: The Town of Marana is pleased to offer you the position of Interim Chief of Police. We are excited about the potential that you bring to our organization. The following outlines the terms of this appointment. • Your appointment to this position is contingent upon a satisfactory background investigation, driving record, pre-employment drug screen and confirmation by the Marana Town Council on April 29, 2008. • This is an interim, temporary, at-will appointment for a period of no more than six months except that the Town retains the option to renew this interim appointment in six-month increments. However, the total term of the interim appointment shall not exceed 18 months and may be terminated at any time by the Town of Marana with or without cause. • Your office will be located at the Police Department in the Marana Municipal Complex. You will report directly to me (Michael Reuwsaat, Town Manager). Your first day of work shall be April 30, 2008. • You are responsible for making application to Arizona POST by May 1, 2008 for active certification as a sworn peace officer and to meet all requirements to obtain and maintain an active Arizona POST certification as a sworn peace officer during the term of this interim appointment. Failure to apply and/or maintain the Arizona POST active certification as a sworn peace officer will result in termination of this agreement. • The Interim Police Chief position is exempt from the provisions of the Fair Labor Standards Act (ELBA). The normal work week is Monday through Friday from 8:00 a.m. to 5:00 p.m. As an individual employed in an exempt position, you will be expected to work the hours necessary to satisfactorily perform the responsibilities of the position. • You will be covered under the Town's Worker's Compensation policy during the term of your interim employment. • Your salary compensation shall be $9,376.66 per month, payable in bi-weekly installments on regular Town pay days. • The Town shall withhold Social Security, Medicare and income taxes from all eligible monetary compensation. • Because you have already retired from the Arizona Public Safety Personnel Retirement System (PSPRS), the Town can make no contributions to your PSPRS.account, and your service with the Town in this position will not be credited to your PSPRS account. However, you will be required to participate in the Arizona State Retirement System (ASRS) for public employees. You and the Town will make the required contribution each pay period to ASRS. You will be eligible to participate in the long-term disability coverage provided by ASRS. • You shall receive an initial $600 uniform allowance for uniform purchases, uniform cleaning and associated equipment purchases. The initial $600 allowance shall be payable by May 16, 2008. Subsequent payments will be made during normal payments of uniform allowance monies to sworn police officers for the length of this appointment. The department shall furnish all other equipment normally assigned to the Chief of Police including a service weapon, radio, protective vest, cell phone/blackberry and automobile. All equipment furnished by the department must be returned upon termination of this appointment. • You will earn vacation time at 4.62 hours per pay period and may take that time with prior authorization from the Town Manager. Any earned but unused vacation hours will be compensated as pay upon termination of your employment with the Town. • You will earn sick leave at the rate of 3.08 hours per pay period. Any earned but unused sick leave hours will not be compensated upon termination of your employment with the Town. • You will receive 24 hours of personal leave upon your appointment to this interim position. Any unused personal leave hours will not be compensated upon termination of your employment with the Town. • You will be eligible for all normal paid Town holidays. • You will be granted time off without pay for the period of May 14, 2008 through May 16, 2008 for any days not covered by personal leave. • As the Interim Police Chief and pursuant to Town Code Sections 3-1-2 and 3-1-4 you shall not be subject to the Town personnel policies or procedures or have access to the Town's formal personnel action review procedures. Please indicate your acceptance of this offer, by signing and returning this offer letter to the Human Resources Department by April 29, 2008. In accepting the Town's offer for the position of Interim Chief of Police, you certify your understanding of all of the above-stated conditions of the appointment, including, but not limited to, the following: that your employment will be on an at-will basis and that neither you nor the Town has entered into a contract regarding the duration of your employment. As an at-will employee, you will be free to terminate your employment with the Town at any time, with or without cause or advance notice. Likewise, the Town will have the right to reassign you, to change your compensation, or to terminate your employment at any time, with or without cause or advance notice. We look forward to your arrival, and are confident that you will play a key role in our Town goals and mission. DISCUSSION Staff will present the revenue projections used in the development of the fiscal year 2009 operating budget. Additionally, staff will discuss the recommended supplemental requests and the Town's compensation and benefit package. ATTACHMENTS The presentation will be handed out prior to the meeting.
