AN ORDINANCE AMENDING TOWN ORDINANCE 77-5 BY AMENDING THE TERM OF
OFFICE FOR THE TOWN MAGISTRATE
WHEREAS the Town of Marana did enact that certain
Ordinance No. 77-5, as amended by the action of the Town Council
of July 14, 1980; and
WHEREAS the Town of Marana does now wish to amend said
Ordinance relating to the term of office of the Town Magistrate
as a result of the decision of the Arizona Supreme Court in
Winter vs. Coor, Supreme Court No. 17332, and Rua vs. Acosta,
Supreme Court No. 17474.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF
THE TOWN OF M3LRANA, ARIZONA that Ordinance No. 77-5, Article II,
appointment and term of Town Magistrate, is hereby deleted, and
the following Article II is hereby adopted for said Ordinance:
"APPOINTMENT AND TERM OF TOWN MAGISTRATE:
There shall be appointed by the Council a Town
Magistrate and such assistants as are
necessary for the performance of the office.
The Town Magistrate shall be appointed by the
Town Council for a term of two years,
commencing July 1 of 1985, with subsequent
appointments of the Town Magistrate and
Assistant Magistrates on July 1 of each and
every odd numbered year thereafter. The Town
Magistrate and Assistant Magistrates shall not
be entitled to any increase in compensation
during the period of that Magistrate's term of
office. During said term, the Town Magistrate
and Assistant Magistrates may be removed only
for cause. The provisions of this Article
shall not apply to Special Magistrates or
acting Magistrates appointed by the Town
Council pursuant to Resolution No. 83-015, for
the purposes of hearing a particular case, or
as a substitute for the Town Magistrate in the
Town Magistrate's actions."
WHEREAS the immediate operation of this Ordinance is
necessary for the efficient administration and operation of the
Town and its employees, an emergency is hereby declared to exist,
and this ordinance shall be in full force and effect from and
passage, adoption and approval by the Town Council of
