HomeMy WebLinkAboutOrdinance 85.03 Amending personnel policiesORDINANCE NO. 85.03 AN ORDINANCE AMENDING THE PERSONNEL POLICIES OF THE TOWN OF MARANA, CREATING THE OFFICE OF ToWN MANAGER, PRESCRIBING THE DUTIES THEREOF, DEFINING THE POWERS INCIDENT TO THE POSITION, AND DECLARING AN EMERGENCY. BE IT ORDAINED BY THE MAYOR AND TOWN COUNCIL OF THE TOWN OF MARANA, ARIZONA, AS FOLLOWS: 1. That Section 01 of the Personnel Policies of the Town of Marana, Arizona, is amended by adding Section 01.02, which reads as follows: SECTION 01.02. RESPONSIBILITIES AND OFFICE OF THE TOWN MANAGER 01.02.01. APPOINTMENT: QUALIFICATIONS: TERM OF OFFICE. The Town Manager shall be appointed by a majority vote of the Town Council for an indeterminate term. The Town Manager shall be chosen by the Council on the basis of his or her executive and administrative qualifications and his or her knowledge of accepted practice in respect to the duties of the office as hereinafter set forth. The Town Manager shall serve at the pleasure of the Town Council. 01.02.02. RESIDENCY REQUIREMENTS. At the time of his or her appointment, the Town Manager need not be a resident of the Town or of the State, but during his or her tenure of office, the Town Manager shall reside inside the boundary of the Marana Unified School District # 6. 01.02.03. INELIGIBILITY OF COUNCILMEMBER No Councilmember shall be appointed Town Manager during the term for which he or she shall have been elected to the Council. 01.02.04. REMOVAL FROM OFFICE. The Town Manager may be removed by the Council by a majority of its members with or without cause upon 30 days notice. The Town Manager must give 90 days written notice of his or her intent to resign. 01.02.05. POWERS AND DUTIES. The Town Manager shall be the executive officer and head of the administrative branch of the Town. Ho or she shall be responsi- ble to the Town Council for the proper administration of all affairs of the Town. He or she have the power and shall b~ required to: (a) General administrative supervision. Execute, on behalf of the Town Council, general administrative supervision and control of the affairs of the Town. (b) ~ttendance, etc., at Council Meetings. Attend all meetings of the Town Council with the duty of reporting on or discussing any matter COncerning the affairs of the departments, boards, services or activities under his or her supervision, upon which, should be informed. Exceptions to attending meetings of the To~ Council may be granted upon written request by the Town Manager and approved by the Mayor. (c) Appointments to amd removal from office. To appoint, and when necessary, suspend or remove all appointive officers and employees of the Town, except as hereafter provided. All appoint- ments and removals shall be based upon merit and up.' the qualifi- cations or disqualifications of such officer or employee without regard to any political belief or affiliation, and in coordination with the appropriate Department Head. The power of appointment, suspension, or removal of the Town Attorney, Chief of Police, and Town Mmgistrate shall be expressly reserved to the Town Council. (d) Coordination of administrative functions, Coordinate the administrative functions and operations of the various departments, boards, divisions and services of the Town Governmen~ and on its behalf to carry out policies, rules, regulations and ~dinances adopted by it, relating to the administration of the affairs of such departments, boards, divisions or services. (e) Budget. Cause to be prepared and submitted to him or her by each department, board, division or service of the Town Govern- ment, itemized annual estimates of expenditures required by them for capital outlay, salaries, wages and miscellaneous operating costs; to tabulate the same into a preliminary consolidated munic- ipal budget and submit the same to the Town Council annually on the date specified by it, with his or her recommendations as to any in- creases, decreases, cancellations, transfers or changes in any of the items included in the preliminary budget. (f) Purchasing. Supervise the expenditures of all departments, divisions or services of the Town Government and to act as Purchasing Agent for the purchase of all supplies, goods, wares, merchandise, equipment and material which may be required for any of such depart- ments, divisions or services, provided that no single purchase or group of purchases of like items shall total more than 1,000.00 dol- lars unless approved by Council action. (g) Recommendations to Council. Analyze and supervise the func- tions, duties and activities of the various departments, boards and services of the Town Government and all employees thereof, and to make such recommendations to the Town Council with reference there- to, as in his or her judgment will result, if made effective, in the highest degree of efficiency in the overall operation of the Town Government. (h) Development o__fimprovement projects an~ p~ograms. Develop and organize necessary improvement projects and programs and to aid and assist the Town Council and the various departments and boards in carrying the same through to a successful conclusion. (i) Public relations. Serve as Public Relations Officer of the Town Government, and to follow through and endeavor to adjust all complaints filed against any employee, department or service thereof to the end that every effort may be made to satisfy all citizens that their Town Government is being operated in their be- half with the highest degree of efficiency. (j) Cooperation with community organizations. Cooperate with all community organizations whose aims and purposes it is to advance the interests of the Town and its residents and to provide them with all reasonable assistance obtainable through the Town Government within the limitations of the law. (k) Persona~property of Town. Make and keep an up-to-date inventory of all personal property owned by the Town and to recom- mend to the Town Council the purchase of new machinery, equipment and ~upplies whenever, in his ~r her judgment, the same can be ob- tained at the best advantage, taking into consideration trade-in value of machinery, equipment, etc. in use. (1) Consolidation, abolishment, etc., of Town Offices. Make, or cause to be made, studies and surveys of the duties, responsi- bilities and work of the personnel in the various departments and services of the Town Government, and to recommend to the Town Coun- cil abolition or consolidation of positions or transfers or removal of personnel, whenever in his or her judgement, such action would increase efficiency in the administration of the Town Government. (m) Enforcement of Laws. In cooperation with the Marana Police Department to see that all laws and ordinances of the Town of Marana and the State of Arizona are duly enforced. (n) Devotion of entire time to duties. Devote his or her entire work effort to the discharge of his or her official duties. Excep- tions to this requirement may be granted by the Town Council acting upon a written request from the Town Manager. (o) Additional duties. Perform such other duties as may be re- quired of him or her by the Town Council, not inconsistent with the laws of the State or the Ordinances of the Town. 01.02.06. LIMITATIONS UPON RESPONSIBILITY. The Town Manager shall not exercise any policy making or legis- lative functions whatsoever, nor attempt to commit or bind the Town Council or any member thereof to any action, plan or program re- quiring official action of the Town Council. It is not intended by this article to grant any authority to, or impose any duty upon the Town Manager which is vested in or imposed by general law or Town Ordinances in any Town Commission, Board, Officer or employee ex- cept herein specifically set forth. 01.02.07. CONDUCT. A. In the discharge of his or her duties as Town Manager, the person holding such position shall endeavor at all times to exercise the highest degree of tact, patience and courtesy in his or her con- tacts with the public and with all Town Boards, Departments and em- ployees and shall use his or her best efforts to establish and main- tain a harmonious relationship between all personnel employed in the government of the Town to the end that the highest possible standards of public service shall be continuously maintained. B. The Town Council shall annually conduct a comprehensive per- formance review of the Town Ymnager. 01.02.08. BOND. The Town Manager shall furnish a surety bond to be approved by the Council in the sum of 25,000 dollars, such bond to be conditioned on the faithful performance of his or her duties. 01.02.09. COMPENSATION. The Town Manager shall receive such compensation as the Council shall fix from time to time. 2. The existing sections of the personnel policies of the Town of Marana are hereby re-numbered as follows: (a) Existing 01.02 (Responsibilities of the Town Clerk) are hereby re-numbered as 01.03; 01.02.01 is re-numbered as 01.03.01; 01.02.02 is re-numbered as 01.03.02; 01.03 (Responsibilities of department heads) is re-numbered as 01.04; 01.03.01 is re-numbered as 01.04.01; 01.03.02 is re-numbered as 01.04.02; 01.03.03 is re- numbered as 01.04.03; 01.03.04 is re-numbered as 01.04.04; 01.04 (Responsibilities of other supervisors) is re-numbered as 01.05; 01.04.01 is re-numbered as 01.05.01; 01.04.02 is re-numbered as 01.05.02; 01.05 (Responsibilities of employees) is re-numbered as 01.06; 01.05.01 is re-numbered as 01.06.01; 01.05.02 is re-numbered as 01.06.02; 01.05.03 is re-numbered as 01.06.03. 3. It is necessary for the preservation of peace, health and safety of the Town of Marana, Arizona, for an emergency to be declared to exist and this ordinance is declared to be effective immediately upon its passage and adoption.
