Ordinance 85.06 Amending Ordinance 83.04 relating to sewage sludge
ORDINANCE NO. 85.06 AN ORDINANCE AMENDING TOWN ORDINANCE NO. 83.04 RELATING TO THE MINIMUM DEPTH FOR THE APPLICATION OR INJECTION OF SEWAGE SLUDGE WHEREAS the Town Council of the Town of Marana did inact that certain Ordinance 83.04 on the 18th day of May 1983; and WHEREAS the Town of Marana does now wish to amend said Ordinance with respect to the minimum permissable depth for the application or injection of sewage sludge. NOW, THEREFORE, BE IT ORDAINED BY THE TOWN t ~NCIL OF THE TOWN OF MARANA, ARIZONA as follows: 1. That paragraph number one (1) of Ordinance 83.04 be amended to read as follows: "(1) The use of land within the Town of Marana that is within one-quarter mile a human residence that is also within the Town of Marana for the application of or injection of sewage sludge to the surface or within eight (8) inches of the surface shall be prohibited, except where said residence is owned by the owner of the land where sludge is to be applied or injected or wh~ a written waiver has been obtained from the resident or owner of the residence and where said waiver has been filed with the Town Clerk." 2. That paragraph numbered two (2) of ©-~inance 83.04 be amended to read as follows: "(2) The use of l~,~d within the designated flood plain of the Santa Cruz River as defined by the Town Zoning Ordinance or Development Code for the application of or injection of sewage sludge within eight (8) inches of the surface shall be prohibited." 3. That paragraph numbered three (3) of Ordinance 83.04 be amended to read as follows: "(3) The use of any other land within the Town of Mararia for the application of or injection of sewage sludge to the surface or within eight (8) inches of the surface shall be in accordance with standards and regulations of the United States Environmental Protection Agency, the Arizona Department of Health Services, and the PimaCounty Health Department for the protection of those who may work on said land and for those who may use such land at a later time for purposes other than the growing of crops or other agricultural purposes, including residential, commercial, industrial, and public land uses." 4. WHEREAS the immediate operation of the provisions of this Ordinance is necessary for the preservation of the public peace, health and safety of the Town of Marana, an emergency is hereby declared to exist, and this Ordinance shall be in full force and effect from and after its passage, adoption and approval by the Town Council oL Marana.
