B. PLEDGE OF ALLEGIANCE AND INVOCATION/MOMENT OF SILENCE
Mayor Honea led the pledge of allegiance.
C. APPROVAL OF AGENDA
Motion: Approve, Moved by Council Member Post, second by Council Member McGorray.
Approved unanimously.
D. CALL TO THE PUBLIC
None.
E. PRESENTATIONS/DISCUSSION/DIRECTION/POSSIBLE ACTION
1. Resolution No. 2008-57: Relating to the Police Department; providing for the
appointment of Terry Tometich as Interim Chief of Police; and declaring an
emergency
Mike Reuwsaat presented this item to Council. Mr. Reuwsaat recommended the
appointment of Terry Tometich as Interim Chief of Police due to the retirement of Chief
Richard Vidaurri. Mr. Tometich is a Marana resident who after 31 years of police
service retired from the Arizona Department of Public Safety. Mr. Tometich addressed
Council and told them he was honored that they chose him for the position. The
appointment will be effective Apri130, 2008.

Council Member Ziegler asked if Mr. Tometich would be able to apply for the fizll-
timepermanent position of Chief of Police. Mr. Reuwsaat responded that it would be
Mr. Tometich's decision to apply for the position once the search process is started.
Council Member Clanagan stated that he had some concerns with this process but after
speaking with Mr. Reuwsaat and Mr. Tometich he is voting aye on this item.
Motion: Approve, Moved by Council Member McGorray, second by Council Member
Comerford Approved unanimously.
Mayor Hones welcomed Mr. Tometich to the Town. Mr. Reuwsaat welcomed Mr.
Tometich aboard and added that he is looking forward to his presence and the value that
he brings to the organization at an important time.
2. Presentation: Fiscal Year 2008-2009 revenue projections and Manager's
recommended supplemental requests
Mike Reuwsaat and Erik Montague presented this item to Council. Mr. Reuwsaat
stated that he is extremely pleased with the Department Heads proposing both 5% and
10% budget cuts should the base budgets need to be cut.
Mr. Montague gave a PowerPoint presentation. Copies of the presentation are available
for viewing at the Town Clerk's Office. The adoption of the tentative budget will be on
May 20. The final budget is set to be adopted on June 17. The next budget study session
will be held May 6.
After general questions from Council of the items, Council thanked Mr. Montague for
his work.
No action taken.
3. Discussion/Direction/Action based on executive session relating to 11~Larana Town
Magistrate James West NOTE: This item will follow the executive session for item
F.3.
Frank Cassidy addressed Council stating: "Mr. Mayor, in the executive session some
information was presented to you about alleged retaliatory conduct by Judge West last
week against a court employee, and the Judge had suspected this court employee of
participating in the investigation that ended up leading to the Judge's reprimand from the
Arizona Commission on Judicial Conduct this February. Based on the information
presented, what is the Council's desire?"
Motion: Moved by Council Member Ziegler: I make a motion that we remove Judge
West immediately for cause. The motion was seconded by Council Member Clanagan.
Approved 6-0. (Council Member Post was excused during the executive session due to
a family emergency.)

Motion: Adjourn to Executive Session, Moved by Council Member Post, Seconded by
Ziegler. (Council adjourned to executive session for Item F.3)

Council returned to public session at 9:27 P.M.
Motion: Adjourn to Executive Session, Moved by Vice Mayor Kai, second by Council
Member Clanagan. (Council adjourned to executive session for Item F.2)

1. Executive Session pursuant to A.R.S. §38-431.03 (A)(3), Council may ask for
discussion or consultation for legal advice with the Town Attorney concerning any
matter listed on this agenda.
2. Executive Session pursuant to A.R.S. § 38-431.03(A)(3),(4) and (7), discussion or
consultation for legal advice with the Town's attorneys and discussion and to
consider its position and instruct the Town Manager and staff concerning the
lawsuit entitled Town of Marana v. Pima County/Pima County v. Marana
(consolidated), Maricopa County Superior Court No. CV2008-001131.
No action taken.
3. Executive Session pursuant to A.R.S. §38-431.03 (A)(1), (3) and (4) for discussion or
consideration of employment, assignment, appointment, promotion, demotion,
dismissal, salaries, disciplining or other appropriate personnel action relating to
Marana Town Magistrate James West, and legal advice and direction to the Town's
representatives relating to same.
See item E.3, above.
G. FUTURE AGENDA ITEMS
Notwithstanding the mayor's discretion of what items to place on the agenda, if three or
more council members request an item to be placed on the agenda, it must be placed
upon the agenda for the second regular town council meeting after the date of the
request (Marana Town Code, Title 2, Chapter 2-4, Section 2-4-2 B)

H. ADJOURNMENT
Motion: Adjourn, Moved by Council Member Clanagan, second by Vice Mayor Kai,
passed by a vote of 4-0. (Council Member Post having been excused during the first
executive session due to a family emergency and Council Members McGorray and
Comerford having been excused prior to the second executive session.
Meeting adjourned at 9:54 P.M.
