OF PA~ES~ 5 SEQ~CE= 20031331315 07/11/2003 O~DIN 16=42 MAIL AMOUNT PAID $ 8.00 MARANA ORDINANCE NO. 2003.14 AN ORDINANCE EXTENDING AND INCREASING THE CORPORATE LI/vl/TS OF THE TOWN OF MARANA, ARIZONA, PURSUANT TO TI-IE PROVISIONS OF TITLE 9, CHAPTER 4, ARIZONA REVISED STATUTES, AND AMENDMENTS THERETO, BY AN'NEX~G THERETO THAT TERRITORY KNOWN AS THE SAGUARO RANCH NORTH ANNEXATION, ENCOMPAS SING PORTIONS OF SECTIONS 17 AND 20, IN TOWNSHIP 11 SOUTH, RANGE 13 EAST, GILA AND SALT RIVER MERIDIAN, PIMA COUNTY, ARIZONA, AND CONTIGUOUS TO THE TOWN'S BOUNDARIES. WHEREAS, petitions in writing, accomparfied by a map or plot of said real property, having been filed and presented to the Mayor and Council of the Town of Marana, Arizona, siguad by the owners of in excess of 50 percent of the value of the real and personal property and over 50 percent of the persons owaing real and personal property that would be subject to taxation by the Town of Marana as shown by the last assessment of said property, saldpropertybelng contiguous to the Town of Marana, and not now embraced within its limits, asldng that the property more particularly hereinafter described be annexed to the Town of Marana, and to extend and increase the corporate limits of the Town of Marana so as to embrace same; and WHEREAS, the Mayor and Council of the Town of Marana, Arizona, are desirous of complying with said petitions and extending and increaskng the corporate li~nits of the Town of Marana to inehide said territory, which is approximately 461 acres; and WHEREAS, the Saguaro Ranch North Annexation is an area w/thin portions of Sections 17 and 20 within Township 11 South, Range 13 Easg Gila and Salt Privet Meridian, P/ma County, .~izona; and WI-I~REAS, the petitions set forth a true and correct description of ali the exterior boundaries of the entire area proposed to be annexed to the Town of Marana and had attached thereto at all times an accurate map of the territory desired to be annexed; and WHEREAS, no alterations increasing or reducing the territory sought to be annexed have been made after a~y petition was signed by any owner of real and personal property in such territory; and WHEREAS, the zoning classification of the property prior to annexation was "Pima Coun~ Zone RH" (Rural Homestead)_ In order to establish original Town of Marana zoning without permitting deosities or uses that are greater than those perm/tted in ?ima County the properties will translate to the RD-180 (Rural Development) zone in the Town of Marana'$ land use and Mamm Ordinance Iqo, 2003,14 --Page 1 of 2- development code, and WHEREAS, the provisions ofA.R.S. § 9-471, and all amendments thereto, have been fully observed; and WHEREAS, proper and sufficient certification and proof of the foregoing face are now on file in the office of the Town Clerk of the Town of Marana, together with a tree and correct copy of the original petition referred to herein, which is on file m the office of the County Recorder. NOW, THEREFORE, BE IT ORDAINED bythe Mayor and Council of the Town of Marana, Arizona, that: The territory known as the Saguaro Ranch North Annexation is annexed into the Town of Marana and that the present corporate limits are extended and increased to include the described area. A copy of this Ordinance, together with an accurate map of the tenitory hereby annexed to the T own o fM arana, e ertified b y the Mayor ofthe T own, s hall b e forthwith filed and recorded in the office of the County Recorder of Pima County, Arizona. The zoning classification of"Pima County Zone RH" (Rural Homestead) within the annexed area is hereby changed to "Town of Marana Zone RD-180" (Rural Development). On file in the office of the Town Clerk of the Town of Marana, Arizona, are those certain documents, known as Exhibits A and B, which are recorded and hereby referred to, adopted, and made a part oftMs Ordinance, describing and illustrating the Saguaro Ranch North Annexation area.
