HomeMy WebLinkAboutOrdinance 95.01 Zoning change at Ina Road and Meredith Boulevard ORDINANCE NO. 95.01 AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA, CHANGING THE ZONING OF CERTAIN PROPERTY (APPROXIMATELY 1.8 ACRES) LOCATED AT INA ROAD AND MEREDITH BOULEVARD FROM "CO" TO "NC". WHEREAS, William K. Wonders is the owner of a parcel of land near the comer of Ina Road and Meredith Boulevard, approximately 1.8 acres in size and more particularly set forth in Exhibit A attached hereto, which is currently zoned "CO" (Commercial Office); and WHEREAS, the applicant has applied to the Town of Maran a to change the zoning of this property from "CO" to "NC", as more particularly set forth on Exhibit B attached hereto; and WHEREAS, the Marana Planning Commission held a public hearing on the rezoning request on November 30, 1994, and following this public hearing recommended that the Town Council approve, with conditions, the request for rezoning to ''NC''; and WHEREAS, the Town Council of the Town of Maran a held a public hearing on the rezoning request on January 3, 1995, to obtain public input on the request for a change of zoning, and heard from staff and the representative of the owner, and has determined that the rezoning request should be approved, with conditions. NOW, THEREFORE BE IT ORDAINED that the Mayor and Council of the Town of Marana, Arizona does hereby change the zoning of the property particularly described on Exhibit A hereto, from "CO" to ''NC'', as set forth on Exhibit B hereto, subject to the following conditions: 1. A detailed site plan shall be returned to the Planning Commission for acceptance and approval. 2. The property owner shall meet all Town Engineer's concerns as outlined in Exhibit C attached hereto, especially in issues related to the traffic, grading, culvert, entrance and other issues that may apply to the approval of the detailed site plan. 3. The property owner shall comply with any traffic threshold set forth by the Town Engineer and shall not exceed this figure. At any time the threshold is exceeded, the property owner shall be required to make improvements to the public right of way, and a development agreement outlining such improvements must be entered into between the Town and the property owner. Any development agreement shall be reviewed and approved by the Planning Administrator and the Planning Commission, and approved by the Town Council before a site plan is approved.
