ORDINANCE NO. 95.09 AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA AMENDING THE TORTOLITA MOUNTAIN PROPERTIES SPECIFIC PLAN, MODIFYING THE AliGNMENT OF TORTOLITA PARKWAY, MOORE ROAD AND THORNYDALE LOOP, CORRECTING TYPOGRAPIITC AND PAGINATION ERRORS, AND AUTHORIZING SUBSTITUTE PAGES TO THE SPECIFIC PLANS. WHEREAS, WCA Communities, Inc. currently owns and is developing that area within the Town of Marana which is ~Jbject to the Tortolita Mountain Properties Specific Plan; and WHEREAS, the Specific Plan currently reflects that Tortolita Parkway and Thornydale Loop run generally north/south along the western portion of the property and east/west through Section 25 respectively; and WHEREAS, the Specific Plan currently contains various errors including typographical errors, pagination errors, cross-reference errors, and the like, all of which are listed in memorandum to the Town of Marana, dated March 20, 1995 and attached hereto as "Exhibit A"; and WHEREAS, the Town desires to realign the roadways, and also desires to correct the various other errors in the Specific Plan as described on Exhibit A; and WHEREAS, the Marana Planning Commission held a public hearing on the amended Specific Plan on March 29, 1995, and following this public hearing unanimously recommended that the Town Council approve Exhibit A as the proposed Specific Plan amendments; and WHEREAS, the Town Council of the Town of Marana held a public hearing on the amended Specific Plan on April 18, 1995 to obtain public input on the proposed amendments to the Specific Plan, and believes that the amendments to the Specific Plan are in the Town's best interests. NOW, THEREFORE BE IT ORDAINED that the Mayor and Council of the Town of Marana, Arizona does hereby adopt and approve the amendments to the Specific Plan for Tortolita Mountain Properties as more fully set forth in that public record entitled "April 1995 Amendments to the Tortolita Mountain Properties Specific Plan", which document was declared a public record pursuant to Marana Resolution No. 95-21 on April 18, 1995. BE IT FURTHER ORDAINED that Section D of Marana Ordinance 89.22, which reads, "That Exhibit IV -7 be amended to reflect that Thornydale extend to the westerly edge of the Specific Plan area" is hereby rescinded. BE IT FURTHER ORDAINED that if any section, subsection, sentence, clause, phrase or portion of this ordinance or any part of the Specific Plan Amendments adopted herein by reference is for any reason held to be invalid or unconstitutional by the decision of any court of Ordinance No. 95.09 Page 1 of 2 competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
