AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA, CHANGING THE ZONING
OF APPROXIMATELY 2.88 ACRES OF LAND LOCATED 3/8 MILE NORTH OF
CORTARO ROAD WEST OF CAMINO DE OESTE, FROM "ZONE C" (LARGE LOT ZONE
WITH MINIMUM LOT SIZE OF 25 ACRES) TO "ZONE R-36" (RESIDENTIAL, MINIMUM
LOT SIZE OF 36,000 SQUARE FEET), AND CHANGING THE ZONING OF
APPROXIMATELY 2.14 ACRES OF LAND LOCATED 3/8 MILE NORTH OF CORTARO
ROAD WEST OF CAMINO DE OESTE, FROM "ZONE C" (LARGE LOT ZONE WITH
MINIMUM LOT SIZE OF 25 ACRES) TO "ZONE R-36" (RESIDENTIAL, MINIMUM LOT
SIZE OF 36,000 SQUARE FEET).
WHEREAS, Timberline Land and Cattle Company is the owner of a parcel of land
approximately two and nine-tenths (2.88) acres in size North of Cortaro Road and West of
Camino de Oeste, more particularly set forth in Exhibit" A" attached hereto, which is currently
zoned "Zone C" (Large Lot Zone with minimum lot size of 25 acres); and
WHEREAS, Superstition Sales, Inc., is the owner of a parcel of land approximately two
and one-tenth (2.14) acres in size North of Cortaro Road and West of Camino de Oeste, more
particularly set forth in Exhibit "B" attached hereto, which is currently zoned "Zone C" (Large
Lot Zone with Minimum lot size of 25 acres); and
-
WHEREAS, these two parcels were created without authority by the Town, and the
division which created these parcels was not allowed under the zoning which existed; and
WHEREAS, the owners have applied to the Town of Marana to change the zoning of
both parcels from "Zone C" (Large Lot Zone with minimum lot size of 25 acres) to "Zone R-
36" (Residential, minimum lot size 36,000 square feet); and
WHEREAS, the Town does not recognize the parcel split, and will treat both parcels as
one parcel for the purposes of the Town's subdivision requirements in Title 6 of the Marana
Land Development Code; and
WHEREAS, the Marana Planning Commission held a public hearing on the rezoning
request on May 31, 1995, and following this public hearing recommended that the Town Council
grant the request for rezoning; and
NOW, THEREFORE BE IT ORDAINED that the Mayor and Council of the Town of
Marana, Arizona does hereby change the zoning of the property particularly described on
Exhibits "A" and "B" hereto, from "Zone C" (Large Lot Zone with minimum lot size of 25
acres) to "Zone R-36" (Residential, minimum lot size 36,000 square feet), under the following
condition:

1. A parcel plat shall be submitted to, and accepted by, Town staff prior to building
permits being issued. Access to all parcels and the dedication of additional right-
of-way along Camino de Oeste shall be made as part of this parcel plat.
PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona,
this 18th day of July, 1995.
