ORDINANCE NO. 95.16
AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA, PROVIDING FOR THE
ESTABUSHMENT AND AMENDMENT OF ANNEXATION AND DEVELOPMENT FEES
TO OFFSET COSTS TO THE TOWN ASSOCIATED WITH PROVIDING NECESSARY
PUBLIC SERVICES TO A DEVELOPMENT.
WHEREAS, the Town of Marana is authorized to assess development fees to offset costs
to the municipality associated with providing necessary public services to a development pursuant
to A.R.S. ~ 9-463.05; and
WHEREAS, development fees shall result in a beneficial use to the development, and
monies received from these development fees shall be placed in a separate fund and accounted
for separately and may only be used pursuant to A.R.S. ~ 9-463.05; and
WHEREAS, notice of the Town of Marana's intention to assess a new or increased
development fee and notice of public hearing were published on March 10, 1995; and
WHEREAS, a written report, including documentation supporting the assessment, was
made available to the public; and
"'_ WHEREAS, the Marana Planning Commission held a public hearing on the proposed
establishment and amendment of annexation and development fees on April 26, 1995, and
following this public hearing recommended that the Town Council adopt the proposed
modification.
NOW, THEREFORE BE IT ORDAINED by the Mayor and Council of the Town of
Marana, Arizona as follows:
SECTION I: The amended and newly established annexation and development fees for
the Town of Marana, Arizona set forth in the attached fee schedule ("Exhibit A") are hereby
adopted.
SECTION IT: The newly established annexation and development fees for the Town of
Marana, Arizona will become effective and enforced ninety (90) days following their formal
adoption by the Marana Town Council, to wit October 3, 1995.
SECTION ill: The adoption of this ordinance setting forth the. annexation and
development fees for the Town of Marana shall have the effect of invalidating that portion of
all previous ordinances which impose annexation or development fees that are different than the
fees set forth in the attached fee schedule ("Exhibit A").
SECTION IV: In the event that any provision, or any portion of any provision, of this
,.- ordinance or the application thereof, is held invalid, illegal or unenforceable, such invalidity,
illegality or unenforceability shall have no effect on the remaining portion of any provision or

any other provision, or their application, which can be given effect without the invalid provision
or application and to this end the provisions of this ordinance shall be deemed to be severable.
PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona,
this 5th day of July, 1995.
