HomeMy WebLinkAboutOrdinance 95.20 Relating to magistrate court costs ORDINANCE NO. 95.20 AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, RELATING TO THE MAGISTRATE COURT, AUTHORIZING COLLECTION OF COURT COSTS, AND SCHEDULE THEREFOR. WHEREAS, the establishment of regulations for the collection of court costs relating to the Magistrate Court is deemed necessary in order to provide for the furtherance of the public peace, health, safety and welfare; and WHEREAS, A.R.S. ~ 22-402 requires incorporated cities and towns to have a police court; and WHEREAS, the Town of Marana is a municipal corporation of the State of Arizona and therefor has a police court referred to as the Marana Magistrate Court; and WHEREAS, A.R.S. ~";22-405 et seq. provides for the collection of monies owed to the municipal court for delinquent fines, fees, sanctions, penalties and restitution; and WHEREAS, A.R.S. ~ 9-240 et seq. empowers the Town Council to make, amend or repeal all ordinances necessary for the carrying into effect of the powers vested in the corporation, or any department or officer thereof; and WHEREAS, the Town Council has determined that the establishment of a fee schedule for collection of court costs is necessary for effective government. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Marana, Arizona, as follows: SECTION 1. The following fee schedule is hereby adopted for the Marana Municipal Court: FEE SCHEDULE FOR COURT COSTS The following fees are established to recover costs associated with fees charged to the town treasury for returned checks and additional costs incurred due to non- appearance in court. Default Judgment Returned Check Fee $38.00 $20.00 SECTION 2. The various town officers and employees are authorized and directed to perform all acts necessary or desirable to give effect to this ordinance. All ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions of the council in conflict with the provisions of this ordinance are hereby repealed, effective as of the effective date of this ordinance. SECTION 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
