AN ORDINANCE OF THE TOWN COUNCIL OF THE 'FOWN OF MARANA, ARIZONA, AMENDING THE MARANA LAND DEVELOPMENT CODE BY ADOPTING TITLE 22, ENTITLED "OFF-STREET PARKING AND LOADING", AND DELETING PORTIONS OF THE DEVELOPMENT CODE IN CONFLICT THEREWITH. WHEREAS, the Town Council of the Town of Marana did on May 14, 1984 adopt Ordinance No. 84.04 which Ordinance adopted a Land Development Code for the Town of Marana, said Ordinance having been amended from time to time; and WHEREAS, the Town Council has determined that it is in the best interests of the Town of Marana to add a new section to the Land Development Code regulating off-street parking and loading within the boundaries of the Town of Marana, and deleting other portions of the Land Development Code in conflict therewith; and WHEREAS, the Marana Planning Commission heIst a public hearing on the proposed modifications to the Land Development Code on July 26, 1995, and following this public hearing recommended by Resolution PCM No. 95-07 that the Town Council adopt Title 22; and WHEREAS, the Town Council of the Town of Marana held a public hearing on the proposed amendments to the Land Development Code on September 5, 1995, in order to obtain public input on the proposed modifications, and has considered the modifications and believes them to be in the best interests of the Town of Marana. NOW, THEREFORE BE IT ORDAINED by the Mayor and Council of the Town of Marana Arizona, as follows: SECTION 1. That certain document known as Land Development Code, Title 22, titled "Off-street Parking And Loading", three copies of which are on file in the office of the town clerk of the Town of Marana, Arizona, said document having been made a public record by Resolution No. 95-50 of the Town of Marana, Arizona, is hereby referred to, adopted and made a part hereof as if fully set out in this ordinance. ' SECTION 2. The Marana Land Development Code is hereby amended by adding Title 22, titled "Off-Street Parking and Loading". SECTION 3. The following sections of the Marana Land Development Code are hereby repealed: Marana, Arizona Ordinance 95.22 Page 1 of 4 TITLE 5 ZONING 05.10.06 R -7 Residential H. Development Standards 6. Parking ftfld CirculatioR Tv.'o parking spaccs of off street parking shall be proyided for eaeh residence. 05.10.07 R-6 Residential H. Development Standards 10. Parking aad Circulation Two parkiRg spaces of off street parking shall be provided for each fCsidcnce. Parking may be ftlrn.ished OR iRdi';iduallots or in commOR parking areas where thc project is composed of attached residential units. Development Standards 11. Parking space reqt:tircments: 1.5 spacer per each ORe bedroom unit, and 2 spaces for all otftCf' tlnits. In addition, 1 guest space for each thrre tlnits shall be provided. One space per tlnit shall bc eovcr<.Xl parking. 05.10.09 MR-l Multi-Family (High Density) H. Development Standards 11. Parking space requirements: 1.5 space per each one bedroom unit, and 2 spaces for all other units. IR addition, 1 guest space for each three units shall be provided. One space per l:lnit shall be covered parking. 05.10.10 RV Recreation Vehicle H. Site Development Standards 7. At least one (1) parking space per rental unit space, and at least t\VO (2) parking spaces per sales lot space shall be provided on each spaee or lot. IN additioR, at least ORe (1) additional guest space shall be pro';ided f-or each ten (10) rental spaces or lots. 05.10.11 MH Manufactured Housing H. Site Development Standards 7. .At least two (2) improved parking spaces per unit space shall be pro'/ided 011 eaeh space or lot. Site Development Standards 5. Access and Traffic Control: d. Off street parking spaces shall be provided at one (1) space per t't'lO hundroo fifty (250) square feet of gross floor area. 05.11.03 VC Village Commercial 1. Site Development Standards (Non-Residential) 6. Off Street Parkmg Areas: All off street parkiflg spaces and servicing drh'es shall be located within the boufldaries of the property. Off street parking spaces shall be one space for each thfCC hUfldred (300) sq\:lare feet of gross floor area. 05.11.04 RC Regional Commercial H. Site Development Standards 6. Off Street Parkmg Areas: All off street parking spaccs and servicing drives shall be located within thc boundaries of the property. Off street parking spaces shall be pro"lided at a ratio of at least one space for each two hundred fifty square feet of gross floor area. TITLE 8 BUILDING CODE 08.03.05 Off Street Parking Space shall bc provided for off street parking on all lots upon which buildings or other StructufCS arc ereeted in accordance with the following schedule. A ~ .... Residential Buildings. Two off street standard parking spaces shall be required for each dV/clling uftit in a single or multiple family residential building or for each separate guest room or suit-c in a commercial lodging facility. Non Rcsidential Buildiflgs. One standard parkiflg space for off street parking shall bc prO'..ided for each full time equivalent employee normally \vorldng at the site during the peak occupancy period. B. SECTION 4. The various town officers and employees are authorized and directed to perform all acts necessary or desirable to give effect to this ordinance. SECTION 5. All ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions of the council in conflict with the provisions of this ordinance are hereby repealed, effective as of the effective date of this ordinance. SECTION 6. If any section, subsection, sentence, clause, phrase or portion of this ,- ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
