HomeMy WebLinkAboutOrdinance 95.24 Regulating the use of traffic signal preemptor devices ORDINANCE NO. 95.24 AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF MARANA, ARIZONA, REGULATING THE USE OF TRAFFIC SIGNAL PREEMPTOR DEVICES; ESTABLISHING EFFECTIVE DATES AND PROVIDING PENALTIES FOR VIOLATIONS. WHEREAS, the Town of Marana is authorized to provide for the public health and safety and the welfare of the people and property within its jurisdiction; and WHEREAS, the Town Council has determined that it is in the best interests of the Town that use of traffic signal preemptor devices be regulated for the safety of the citizens of Marana. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Marana, Arizona, as follows: SECTION 1. The following requirements relating to traffic signal preemptor devices are hereby adopted. A. It shall be unlawful for any person not authorized by the Marana Town Engineer to utilize, alter or interfere with any preemptor device to control an official traffic-control device within the Town of Marana. ~, B. A civil sanction of not less than two hundred fifty dollars ($250.00), which shall not be suspended, shall be imposed on any person found responsible for a violation of section A. SECTION 2. The various town officers and employees are authorized and directed to perform all acts necessary or desirable to give effect to this ordinance. SECTION 3. All ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions of the council in conflict with the provisions of this ordinance are hereby repealed, effective as of the effective date of this ordinance. SECTION 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. .-., Marana, Arizona Ordinance95.12 Page 1 of 2 PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona, this 3rd day of October, 1995.
