HomeMy WebLinkAboutOrdinance 95.27 Amending the water utility code ORDINANCE NO. 95.27 AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, AMENDING THE MARANA WATER UTILITY CODE BY ADDING TWO ADDITIONAL MEMBERS TO THE MARANA WATER UTILITY ADVISORY COMMITTEE. WHEREAS, the Town Council of the Town of Marana on February 27, 1990 adopted Ordinance No. 90.07 adopting a Water Utility Code for the Town of Marana, said code having been amended from time to time; and WHEREAS, it has been determined that the Water Utility Code should be amended to increase the number of members on the Marana Water Utility Advisory Committee from five (5) to seven (7) members and designating that three (3) of the members shall be chosen at large. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Marana, Arizona, as follows: SECTION 1. Section 02.03.03 of the Marana Water Utility Code is amended as follows: (Additions are indicated by REDLINE, deletions are indicated by 8trikee~t) 02.03.03. Membership Composition, Terms and Qualifications The Marana Water Utility Advisory Committee shall be composed of-4We SEVEN members, two of which shall be residential customers, one of which shall be a commercial customer, one of which shall represent agricultural interests other than Cortaro Ma:rana Irrigation District, Bfld ORe of which. shall represefl.t Cortaro Manma IrrigatioR District or the Cortaro 'Water Users AssociatioR. AND THREE OF WHICH SHALL REPRESENT AREAS OF THE TOWN AT LARGE. Members of the Water Utility Advisory Committee shall serve terms of three years, which terms shall be staggered. The initial members of the Water Utility Advisory Committee shall draw lots to determine which three members shall have an initial term of three years. Thereafter members shall serve for terms of three years. SECTION 2. The various Town offices and employees are authorized and directed to perform all acts necessary or desirable to give effect to this Ordinance. SECTION 3. All ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions of the council in conflict with the provisions of this ordinance are hereby repealed, effective as of the effective date of this ordinance. SECTION 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
