ORDINANCE NO. 94.07
AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA, ADOPTING THE
THORNYDALE/TANGERINE REZONING FROM "C" TO "YC", "R-36" AND "R-8".
WHEREAS, the Planning Commission of the Town of Marana, Arizona, after a public
hearing on Apri127, 1994, has submitted PC-Resolution No. 94-09 recommending approval of
the THORNYDALFJTANGERINE REZONING from "C" to "YC", "MR-1" and "R-6" to the
Town Council for the Town of Marana, Arizona, said rezoning requested by Pinetree Properties
to rezone a 324.2 net acre parcel, located near the corner of Tangerine Road and Thornydale
Road;
WHEREAS, on May 17, 1994, the Town Council held a public hearing with respect to
the rezoning request submitted by Pinetree Properties;
WHEREAS, the Town Council has determined that the rezoning request submitted by
Pinetree Properties is consistent with the evolving land use pattern in the are and that "YC",
"R-36" and "R-8" zoning are acceptable;
WHEREAS, the requirements of A.R.S. ~ 9-461.04 have been complied with;
NOW, THEREFORE BE IT ORDAINED that the Mayor and Council of the Town of
Marana does hereby adopt and approve the THORNYDALE/TANGERINE REZONING from
"C" to "YC", "R-36" and "R-8", with stipulations. A vicinity map is attached hereto as
"Exhibit A" and incorporated herein by this reference.
IT IS FURTHER ORDAINED that the THORNYDALE/TANGERINE REZONING is
adopted with the following stipulations:
A. The "YC" commercial designation is conditional on the submittal and approval of a
complete "preliminary Site Plan" by the Marana Planning Commission and Town
Council.
B. The "YC" commercial designation be limited to the Northwest side of Camino de
Manana, and the other areas on the Site Plan designated "YC Commercial" and "MR-1
Multi-Family" shall have "R-8" zoning in conformance with the remainder of the area.
C. A market analysis justifying the commercial and multiple residential development must
be submitted at the time a more definitive development plan is submitted and the
Planning Commission is to review and consider the validity of the market analysis at a
public hearing.
D.
A six hundred (600') foot corridor along the Western and Southern borders of the
property shall be zoned "R-36", with one (1) to two (2) residences per acre. The rest

of the property except the area zoned "VC" shall be zoned "R-8", with three residences
per acre.
E. Approval is subject to the requirements set forth in the Town of Marana Development
Code.
F. Approval is contingent upon the guarantee of sewer capacity.
G. Pinetree Properties or its successors shall submit an amended site analysis that reflects
the stipulations in this Ordinance within 90 days of the adoption of this Ordinance.
H. Pinetree Properties or its successors must comply with the development agreement
existing between Westinghouse and the Town of Marana.
I. The following dedications will be made by Pinetree Properties or its successors:
1. Tangerine Road, 1/2 ROW of 200 feet
2. Thornydale Road, 1/2 ROW of 100 feet
3. Camino de Oeste, 1/2 ROW of 75 feet
4. Camino de Maiiana, Full Width ROW of 200 feet
5. Camino Del Norte, 1/2 ROW of 75 feet
J. Pinetree Properties or its successors will protect and preserve Pima County designated
spine washes.
K. A fiscal impact study will be submitted within 180 days of the adoption of this
Ordinance.
L. Pinetree Properties or its successors will dedicate, free of charge, a ten (10) acre school
site at a site acceptable to the Marana School District, said dedication to occur prior to
the issuance of any building permit within the area.
M. Pinetree Properties or its successors will pave external roads when the adjacent area is
being developed, and shall bring all internal roads to Marana Town Standards prior to
the Town's acceptance of the dedication. Pinetree Properties may participate in any
improvement district formed for the purpose of paving external roads abutting the
rezoned area.
N. A Development Master Plan shall be prepared and submitted to the Town Council in
substantial compliance with the concept plan, prior to any subdivision plat. The
Development Master Plan shall detail each development area in detail, and is specified
in the draft Town of Marana Subdivision Ordinance.
IT IS FURTHER ORDAINED that this rezoning is conditional upon compliance with the
stipulations by Pinetree Properties and its successors and these stipulations are intended to run
with the land.
