HomeMy WebLinkAboutOrdinance 94.09 Zoning change for Patania land near Hartman and Overton ORDINANCE NO. 94.09 AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA, CHANGING THE ZONING OF APPROXIMATELY 100 ACRES OF LAND NEAR THE SOUTHWEST CORNER OF HARTMAN ROAD AND OVERTON ROAD OWNED BY FRANK P ATANIA FROM "C" ZONE TO R-8 WITH CONDITIONS. WHEREAS, Frank Patania is the owner of a parcel of land near the Southwest corner of Hartman Road and Overton Road, consisting of portions of Section 23, Township 12 South, Range 12 East, approximately 100 acres in size, and more particularly set forth in Exhibit A attached hereto, which is currently zoned "c" Zone; and WHEREAS, Frank Patania applied to the Town of Marana to change the zoning of this property from "C" Zone to approximately 97 acres ofR-6 and 3 acres ofNC; and WHEREAS, the Marana Planning Commission held a public hearing on the rezoning request on June 30, 1994, and recommended, with conditions, that the Town Council approve said request for rezoning to R-6; and WHEREAS, the Town Council of the Town of Marana held a public hearing on the rezoning request on July 19, 1994, to obtain public input on the request for rezoning. NOW, THEREFORE BE IT ORDAINED that the Mayor and Council of the Town of Marana does hereby change the zoning of the property particularly described on Exhibit A hereto, from "c" Zone to R-8 as set forth in Exhibit B attached hereto, and subject to the following conditions: 1. The area shown as "commercial" on Exhibit B is not granted NC zoning, but shall be open space, and shall be reflected as such on the final site plan and plat. 2. The rest of the property shall be rezoned to R-8 (residential, 8000 square foot minimum lot size), with no more than four (4) houses per acre. 3. The property will be required to adhere to Marana's Native Plant Ordinance. 4. A report of the two archaeological sites on the property shall be submitted to the town prior to any grading on the site, and grading will not be allowed until the report is sufficient to the town, and the town approves grading. 5. Dedications shall be granted as specified by the Town Engineer. 6. The Comments and Conditions made by the Town Engineer in his correspondence dated June 23, 1994, attached hereto as Exhibit C, shall be adhered to. Off Site Watersheds · Add the definition for a critical basin. Pg 3, I-D Vegetation, Vegetative Inventory, 3rd Paragrapb . Describe which parcel contains the major wash. · Describe what is a Class II riparian wildlife habitat. Pg 3, I-D Vegetation, Vegetative Inventory, 4th Paragraph · There is no mention of Mesquite trees and Ironwood trees. Figure 6 · Show the wash boundaries on this figure. Pg 5~ I-G Traffic, 2f · Eliminate Pt. 2f Figure 10 · Due to the amount of land located within the wash, R-6 zoning will result in a clustered development. Is this conclusion correct? Preliminary Development Plan, 2nd Paragraph · Changing the drainage patterns is not recommended unless the entire area's hydrology is studied and cooperation is obtained from the adjacent and downstream landowners. Pg. 9, ll-E Hydrology, 2. 100 Year Floodplain Encroachment · How much imported fill will be required in order to modify the floodplains.? An Existing Conditions Drainage Piau shall be required in the report. This will aid in review of the modification of the floodplains. Pg. 12, ll-J Traffic: · What about direct access between the parcels as well as access to Hartman Lane? Pg. 13, II-K Sewers · The word "letter" is missing. · Has the developer contacted PCWWM about connecting into the new lift station at 1.10 and Cortaro Farms Roads? General Comment · I recommend that an overall Drainage and Transportation Plan be developed for the entire area before this Site Analysis can be approved.
