ORDINANCE NO. 94.10
AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA, MODIFYING THE CONDITIONS
OF ZONING FOR APPROXIMATELY 9.5 ACRES OF LAND, LOCATED NEAR THE
NORTHWEST CORNER OF INA ROAD AND OLDFATHER ROAD, CHANGING THE
MAXIMUM BUILDING HEIGHT FROM FIFTEEN FEET TO A MAXIMUM BUILDING
HEIGHT OF TWENTY ONE FEET.
WHEREAS, WCI Group, L TD is the owner of a parcel of land, near the Northwest comer
oflna Road and Oldfather Road, approximately 9.5 acres in size, and more particularly set forth in
Exhibit A attached hereto, which was granted a change of zoning in Pima County Zoning Case
#C09-85-35 with a condition of the zoning providing for a maximum building height of fifteen (15)
feet; and
WHEREAS, the applicant has applied to the Town of Marana to modify the conditions of
the zoning to allow a maximum building height of nineteen (19) feet; and
WHEREAS, the Marana Planning Commission held a public hearing on the request to
modifY the conditions of zoning to allow a maximum building height of twenty one (21) feet on June
30, 1994, and recommended that the Town Council approve said request for modification of the
conditions of zoning allowing a twenty one (21) height limitation and requiring that a new
development plan be submitted to staff for review and approval; and
WHEREAS, the Town Council of the Town of Maran a held a public hearing on the request
on July 19, 1994, to obtain public input on the request for a change of conditions.
NOW, THEREFORE BE IT ORDAINED that the Mayor and Council of the Town of
Marana does hereby change the conditions of zoning of the property particularly described on
Exhibit A hereto, allowing a maximum building height of twenty one (21) feet.
BE IT FURTHER ORDAINED that the applicant is to submit a new development plan to
staff for review and approval.
PASSED AND ADOPTED by the Mayor and Council of the Town of Maran a, Arizona, this
19th day of July, 1994.

That portion of Lot 5, in Section 31, Township 12 South of Range 13 East, Gila and
Salt River Base and Meridian, Pima County, Arizona, described as follows:
BEGINNING at a point which is 330 feet Westerly and 30 feet Northerly from the South
Quarter corner of said Section 31, being the TRUE POINT OF BEGINNING.
THENCE Westerly and parallel to the South Section line of said Section 31, a distance
of 330 feet;
THENCE Northerly and parallel to the North and South center line of said Section 31,
a di stance of 660 feet;

of 330 feet;
THENCE Southerly and parallel to the North and South center line of said Section 31, a
