ORDINANCE NO. 94.11
AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA, CHANGING THE ZONING OF
A PORTION OF THE LOT NEAR THE NORTHWEST CORNER OF INA ROAD AND
MEREDITH BLVD. FROM "CO" TO "VC", GRANTING A VARIANCE TO THE PROPERTY
ALLOWING A MINIMUM LOT SIZE OF ONE HALF ACRE, GRANTING A VARIANCE TO
THE PROPERTY ALLOWING A SIDE LOT SETBACK OF ZERO, AND GRANTING A
VARIANCE TO THE PROPERTY ALLOWING A FLOOR AREA RATIO OF 1.05.
WHEREAS, William K. Wonders the owner ofa parcel of land, near the Northwest corner
of Ina Road and Meredith Blvd., approximately 3.8 acres in size, and more particularly set forth in
Exhibit A attached hereto, which is currently zoned CO (commercial office); and
WHEREAS, the applicant has applied to the Town of Marana to change the zoning of this
property from "CO" to "VC", and later modified this request to request "VC" zoning for the back
portion of the property, more particularly shown on Exhibit B hereto; and
WHEREAS, the Marana Planning Commission held a public hearing on the rezoning request
on June 30, 1994, and recommended that the Town Council approve said request for rezoning to
"VC" with conditions; and
WHEREAS, the Town Council of the Town of Maran a held a public hearing on the rezoning
request on July 19, 1994, to obtain public input on the request for a change of zoning; and
WHEREAS the applicant has also requested a number of variances to the zoning
requirements for the property, particularly (1) that the minimum lot size often acres be reduced to
a minimum lot size of one half acre, (2) that the side lot setback of twenty feed be reduced to a side
lot setback of zero feet, and (3) that the floor area ratio be increased from .35 to 1.05.
WHEREAS the Marana Town Council also acts as the Town Board of Adjustment, and as
such is empowered to allow variances to the zoning requirements; and
WHEREAS the Board of Adjustment has determined that granting the requested variances
is necessary and will be in the best interests of the citizens of the Town of Mar ana.
NOW, THEREFORE BE IT ORDAINED that the Mayor and Council of the Town of
Marana does hereby change the zoning of the property particularly described on Exhibit B hereto,
from "CO" to "VC", and subject to the following conditions:
1. All future development shall be measured from future right of way lines as specified by the
Transportation Element of the General Plan.
2. Any necessary street right of way required by the Town Engineer shall be dedicated to the
Town of Mar ana.

3. Issues raised by the Town Engineer in his letter of March 24, 1994, attached hereto as
Exhibit C, shall be addressed to the satisfaction of the Town Engineer.
4. The requested zoning is conditional on the approval of a master site plan which will be
brought before the Planning Commission for its approval.
5. Any change to the overall master site plan must proceed through the same hearing process
which establishes the uses and zoning.
6. That portion of this property that is not included in the area to be rezoned (the remaining
"CO" portion of the property), shall be included in the overall master site plan and condition
No.5 above shall also apply to this portion of the property.
BE IT FURTHER ORDAINED that the applicant is granted a variance to the zoning relating
to minimum lot size for "VC" zoning, and that portion of the property reflected as "VC" Exhibit B
hereto shall allow a minimum lot size of one half acre.
BE IT FURTHER ORDAINED that the applicant is granted a variance to the zoning relating
to the side lot setback, and that portion of the property reflected as "VC" on Exhibit B hereto shall
have a minimum side lot setback of zero.
BE IT FURTHER ORDAINED that the applicant is granted a variance to the zoning relating
to the floor area ratio, and that portion of the property reflected as "VC" on Exhibit B hereto shall
have a floor ratio of 1.05.
PASSED AND ADOPTED by the Mayor and Council of the Town of Maran a, Arizona, this
19th day of July, 1994.
