OF PAGES: 4 SEQUENCE: 19981940229 11/05/98 RES 12:22 PICKUP A.MOUNT PAID MARANA RESOLUTION NO. 98-116 $ 9,00 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARAdqA, ARIZONA, AUTHORIZING THE SUBSTITUTION OF PERFORMANCE BONDS AS ASSURANCES FOR THE COMPLETION OF PUBLIC IMPROVEMENTS OF PHASE I, LOTS 1 THROUGH 97 AND COMMON AREAS A THROUGH E, AND PHASE II, LOTS 98 THROUGH 208 AND COMMON AREAS F THROUGH L, LOCATED IN CONTINENTAL RANCH PARCELS 36 THROUGH 38 AND PARCEL 40 AND AUTHORIZING THE RELEASE OF THE ASSURANCE AGREEMENT ORIGINALLY SUBMITTED BY DEL WEBB'S COVENTRY HOMES OF TUCSON, INC., UNDER TRUST NO. 4708, AND FIRST AMERICAN TITLE, FOR THE COMPLETION OF SUBDIVISION IMPROVEMENTS. WHEREAS, the Town has previously entered into an Assurance Ageement with Del Webb' s Coventry Homes of Tucson, Inc., under Trust No. 4708 (Del Webb), and First American Title, for Completion of Subdivision Improvements on Phase I, Lots 1 through 97 and Common Areas A through E (see Exhibit A), and Phase II, Lots 98 through 208 and Common Areas F through L (see Exhibit B), in Continental Ranch Parcels 36 through 38 and Parcel 40; and WHEREAS, on May 21, 1998, the Assurance Agreement for Completion of Subdivision Improvements for Phase I was recorded and on July 19, 1998 the Assurance Agreement for Completion of Subdivision Improvements for Phase II, all in Continental Ranch Parcels 36 through 38 and Parcel 40, was recorded; and WHEREAS, Del Webb's Coventry Homes of Tucson, Inc. requested to be released from the Third-Party Trust Assurance Agreement for Phase I and Phase II, providing performance bonds as Substitute Assurances for completion o f the remaining subdivision improvements; and WHEREAS, the release of Assurances for Completion of Subdivision Improvements is in the best interests of the citizens of the Town of Marana. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana, Phase I, Lots 1 through 97 and Common Areas A through E, and Phase II, Lots 98 through 208 and Common Areas F through L, in Continental Ranch Parcels 36 through 38 and Parcel 40 are released from the Assurance Agreement for Completion of Subdivision Improvements and the performance bonds in the amount of S63,564.00 (Phase I) and 5432,900.00 (Phase II) posted by Del Webb's Covemry Homes of Tucson, Inc. as assurances for said completion of'improvements.
