HomeMy WebLinkAboutResolution 98-074 release of assurance for continental ranch parcel 23MARANA RESOLUTION NO. 98-74 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, AUTHORIZING THE RELEASE OF LOTS 1 THROUGH 74 AND COMMON AREAS A, B, AND C LOCATED IN CONTINENTAL RANCH PARCEL 23 FROM THE ASSURANCE AGREEMENT WITH DEL WEBB' S COVENTRY HOMES OF TUCSON, INC., UNDER TRUST NO. 4709, AND FIRST AMERICAN TITLE, FOR COMPLETION OF PUBLIC IMPROVEMENTS AND ACCEPTiNG FOR TOWN MAINTENANCE DESIGNATED STREETS WITHIN THE SUBDIVISION. WHEREAS, the Town has previously entered into an Assurance Agreement with Del Webb's Coventry Homes of Tucson, Inc., under Trust No. 4709 (Del Webb), and First American Title, for completion of public improvements on Lots 1 through 74 and Common Areas A, B, and C in Continental Ranch Parcel 23; and WHEREAS, Del Webb has fulfilled its obligation under the Assurance Agreement for Lots 1 through 74 and Common Areas A, B, and C in Continental Ranch Parcel 23, as mom particularly described in Figure 1, attached hereto and incorporated herein by this reference, and now desires that these lots be released from said Assurance Agreement; and WHEREAS, Del Webb and the Town desire to affirm responsibility for future maintenance of public improvements and streets located within the subdivision; and WHEREAS, the release of assurances for the reasons set forth above and the affirmation of responsibility for maintenance of public improvements and streets is in the best interests of the citizens of the Town of Marana. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana as follows: Lots 1 through 74 and Common Areas A, B, and C in Continental Ranch Parcel 23 are released from the Assurance Agreement subject to the following condition: Private drainage easements and private landscape easements located within the released lots will be satisfactorily maintained by the Continental Ranch Community Association or its successor. Marana, Arizona Resolution No. 98-74 Page I of 3 2. The Town accepts for maintenance 0.63 miles of the following paved streets: a. Bodie Road b. Scout Road c. Palladin Road d. Peace Pipe Road e. Sugar Foot Drive f. Corso Del Salto g. Brave Drive The Town accepts for maintenance various other public improvements as agreed between the parties.
