HomeMy WebLinkAboutResolution 98-035 floodplain variance to elaine thornton lamastusMARANA RESOLUTION NO. 98-35 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, ACTING AS THE MARANA FLOODPLAIN MANAGEMENT BOARD, GRANTING A VARIANCE TO ELAINE THORTON-LAMASTUS, FOR PROPERTY LOCATED AT 13672 NORTH JANE AVENUE, MARANA, ARIZONA. WHEREAS, Elaine Thorton-Lamastus is the owner of property located at 13672 N. Jane Avenue, Marana, Arizona, and that property is located within the Federal Emergency Management Agency mapped floodplain; mad WHEREAS, the property owner, applied for a building permit for the placement of a manufactured home on the property located at 13672 North June Avenue, Marana, Arizona, which was denied due to the fact that the property is located within the FEMA designated floodway; and; WHEREAS, Elaine Thorton-Lamatus puchased the property in March of 1993 and the Town has previously allowed the placement of two (2) manufactured homes on the property, one in April of 1993 and the other in January of 1995; and WHEREAS, one of the manufactured homes was removed from the property in June of 1996 and the property owner wishes to move another manufactured home onto the property; and WHEREAS, the Town Council, acting as the Floodplain Management Board, and pursuant to the Marana Land Use and Development Code, Title 21, Floodplain and Erosion Hazard Management Regulations, is empowered to grant such variance, and believes that such variance is authorized by the Land Use and Development Code and is in the best interests of the Town of Marana, Arizona. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana, Arizona, acting as the Floodplain Management Board, that the variance requested for the property located at 13672 North Jane Avenue, Marana, Arizona, is hereby granted and a revised building permit shall be issued for the placement of the manufactured home on the property subject to the following conditions: The Applicant shall supply an acceptable indemnification agreement holding the Town harmless in the event the home, property, persons, etc., are damaged by flood activities and such agreement shall be recorded by the Town Clerk's office; The permit shall comply with the Standards for Manufactured Homes contained in Title 21, Flood Plain and Erosion Hazard Management Code (Section 21.10), regarding specifications for the anchoring system; Marana, Arizona Resolution No. 98-35 Page 1 of 2 The Applicant shall submit proof of flood insurance on an annual basis to the Town of Marana Town Clerk's office; and If the Town of Marana is placed on probation by FEMA, the National Flood Insurance Program (NFIP), or any other federal agency, the homeowner shall take all necessary action to bring the home into compliance, and shall be solely responsible for all costs associated with such compliance.
