HomeMy WebLinkAboutResolution 2005-098 final plat for parcels 56, 57 & 72 continental ranch MARANA RESOLUTION NO. 2005-98 RELATING TO DEVELOPMENT; APPROVING A FINAL PLAT FOR PARCELS 56, 57 & 72 CONTINENTAL RANCH WHEREAS, the Town of Marana approved and adopted the specific plan for the area known as Continental Ranch on April 5, 1988 (Ordinance No. 88.09), located within the corporate boundaries of the Town of Maran a, Arizona; and WHEREAS, the developer, Continental Ranch Development LLC, has applied for approval of a final plat for Parcels 56, 57 & 72 Continental Ranch, Lots 1 through 10; and WHEREAS, the final plat for Parcels 56, 57 & 72 Continental Ranch will consist ofa 10- lot commercial subdivision on approximately 15.8 acres located at the east comer of Cortaro Road and Silverbell Road, within a portion of Sections 34 and 35, Township 12 South, and Range 12 East; and WHEREAS, the final plat for Parcels 56, 57 & 72 Continental Ranch requires abandonment of certain Town rights-of-way and easements depicted on the plat, and the Town Council expressly finds that abandonment of these rights-of-way and easements is in the best interests of the public and the Town; and WHEREAS, the Town Council, at their regular meeting on August 2, 2005 has determined that the final plat for Parcels 56, 57 & 72 Continental Ranch should be approved. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Town of Marana, Arizona, that the final plat for Parcels 56, 57, & 72 Continental Ranch, Lots 1-10, situated on approximately 15.8 acres located at the east comer of Cortaro Road and Silverbell Road, within a portion of Sections 34 and 35, Township 12 South, and Range 12 East is hereby approved. IT IS FURTHER RESOLVED that approval of the final plat for Parcels 56, 57 & 72 Continental Ranch carries out the transfer to the developer and abandonment of a certain 50-foot wide strip of land that had been retained by the Town (partially by fee title and partially by easement) for access and right-of-way purposes in connection with and pursuant to the Real Estate Exchange and Development Agreement recorded in the Pima County Recorder's office at Docket 12201, Page 4073 (see Marana Ordinance No. 2003.32) and the Deed of Easement recorded in the Pima County Recorder's office at Docket 12201, Page 4121, in exchange for the public rights-of-way granted by the final plat for Parcels 56, 57 & 72 Continental Ranch, under the authority of A.R. S. ~ 28-7203, as indicated by the notes on the plat. IT IS FURTHER RESOLVED that approval of the final plat for Parcels 56, 57 & 72 Continental Ranch carries out the extinguishment pursuant to A.R.S. ~ 9-402(E) of that certain {OOOOI020.DOC I} Marana Resolution No. 2005-98 - 1 - 7/27/2005 12:47 PM LS FJe 35-foot drainage, access, utility and clear zone easement created by the instrument recorded in the Pima County Recorder's office at Docket 8097, Page 1950, which is no longer needed by the Town, as indicated by the notes on the final plat for Parcels 56, 57 & 72 Continental Ranch. IT IS FURTHER RESOLVED that the Town Manager is hereby authorized to execute on behalf of the Town any quit-claim deed or other documentation needed or beneficial to evidence the Town's transfer or abandonment of property rights by this Resolution.
