SMARA TOWN OF MARANA ATTN: TOWN CLERK ,13251 N LON ADAMS RD MARANA AZ 85653 MAIL AMOUNT PAID $ 8.00 MARANA ORDINANCE NO. 2001.13 AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, AMENDING TITLE 16, SIGNS, OF THE MARANA LAND DEVELOPMENT CODE TO UPPATE TITLE 16 AND ADDRESS SIGNS IN THE RIGHTS-OF-WAY, POLITICAL SIGNS, SIGN PROGRAMS AND OTHER VARIOUS ISSUES RELATED TO SIGNAGE, ENACTING PENAL TIES, AND REPEALING ALL RESOLUTIONS, ORDINANCES, AND RULES OF THE TOWN OF MARANA IN CONFLICT THEREWITH. WHEREAS, on May 14, 1984, the Town Council of the Town of Marana did approve Ordinance No. 84.04, which adopted the Land Development Code (the "Code") for the Town of Marana; and WHEREAS, the Council has amended the Code from time to time; and WHEREAS, the Town staffhas determined that amendments to Title 16 of the Code, which regulates signs, are necessary to correct inconsistencies found therein and to address issues not covered by that Title; and WHEREAS, the Marana Planning Commission held a public hearing to consider proposed amendments to Title 16 of the Land Development Code on May 30,2001, and its members voted to recommend approval ofthe proposed amendments to the Town Council; and WHEREAS, the Council held a public hearing on July 17, 2001, to consider the proposed amendments to Title 16 and to obtain input from Town staffand the public; and WHEREAS, the Mayor and Council of the Town of Marana find that adoption of the proposed amendments to Title 16 of the Code is in the best interests of the residents and the businesses of the Town of Marana. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of .i Marana, Arizona, as follows: S Section 1: Title 16 of the Marana Land Development Code is hereby amended by deleting the existing text and substituting therefor that certain document entitled "Title 16 - Signs," three copies of which are on file in the office of the Town Clerk, having been declared a public record by approval of Resolution No. 2001-91. ~~j .....ol Section 2: Pursuant to Section 16-15-1 of the Land Development Code, any violation of ... ........ Title 16 constitutes a civil infraction and is punishable by a maximum fine of $500.00, in addition to any other penalties that may apply. Each sign and each day that a violation occurs constitute a separate offense. Section 3: The various Town officers and employees are authorized and directed to perform all acts necessary or desirable to give effect to this Ordinance and portion of the Land Development Code. Section 4: All ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions of the Council in conflict with the provisions of this Ordinance are hereby repealed, effective as of the effective date of this Ordinance. Section 5: Ifany section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions hereof. .- PASSED AND ADOPTED by the Mayor and Council of the Town ofMarana, Arizona, this 1 th day of July, 2001. d~L::u.'
