AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF MARANA, ARIZONA,
AMENDING TITLE 5 OF THE MARANA LAND USE AND DEVELOPMENT CODE TO
DELETE THE CLUSTER DEVELOPMENT OPTION IN THE R-36 (MINIMUM LOT SIZE
36,000 SQUARE FEET) AND R-16 (MINIMUM LOT SIZE 16,000 SQUARE FEET)
SINGLE FAMILY RESIDENTIAL ZONES, AND REPEALING ALL RESOLUTIONS,
ORDINANCES, AND RULES OF THE TOWN OF MARANA IN CONFLICT
THEREWITH.

WHEREAS, on May 14, 1984, the Town Council of the Town of Marana adopted, by
Ordinance number 84.04, a Land Use and Development Code (the "Code") for the Town of
Marana and has amended the Code from time to time; and
WHEREAS, the Code contains Title 5 which provides for zoning regulations for the
Town; and
WHEREAS, within Title 5 there are provisions for R-36 (minimum lot size 36,000
square feet), codified at section 05.10.03 of the Code, and R-16 (minimum lot size 16,000
square feet), codified at section 05.10.04 of the Code, single family residential zones; and
WHEREAS, both the R-36 and. the R-16 single family residential zones contain a
subsection "J" which provides for a cluster development option; and
WHEREAS, on January 26, 2000, the Marana Planning Commission held a public
hearing and after listening to members of the public and town staff voted to recommend that
the Town Council amend the Code to delete subsection "J" from both the R-36 and the R-16
single family residential zones to prohibit use of the cluster development option; and

WHEREAS, the Mayor and Council, after another public hearing on the matter, have
determined that deleting subsection" J" from both the R-36 and the R-16 single family
residential zones to prohibit use of the cluster development option is in the best interest of the
Town and its residents.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of
Marana, Arizona, as follows:
Section 1. That certain document entitled "MARANA LAND USE AND
DEVELOPMENT CODE," three copies of which are on file in the office of the town clerk of
the Town of Marana, Arizona, is hereby amended to delete subsection" J" from both the R-36
and the R-16 single family residential zones, as follows, with deletions depicted in strikeout

R-36 Single Family Residential
A. Purpose
The puq>ose of the R-36 zone is to provide for the development of single family homes on large rural
lots to help protect environmentally sensitive areas, to provide oJ>J>9rtunity for a more rural lifestyle, and
to provide a variety of housing opportunities for the residents of"Marana.
A. Location - (Reserved)
B. Permitted Uses.

A. Accessory Uses
The following accessory buildings and uses may be located on the same lot with a permitted dwelling,
provided that any permanent building or structure shall be harmonious with the arcl1itectural style of the
main building and further provided that all residential accessory uses are compatible with the residential
character of the neighborhood:
1. accessory living quarters or guest room, provided there is no kitchen and the quarters are not
leased or rented;
2. children's play house;
3. greenhouse or lathhouse;
4. non-commercial hobby shops;
5. patios and cabanas;
6. swimming pools, spas, and related structures;
7. tool shed;

A. Purpose

Section 2. The various town officers and employees are authorized and directed to perform
all acts necessary or desirable to give effect to this Ordinance and portion of the Code.
Section 3. All ordinances, resolutions, or motions and parts of ordinances, resolutions, or
motions of the Council in conflict with the provisions of this Ordinance are hereby repealed,
effective as of the effective date of this Ordinance.
Section 4. If any section, subsection, sentence, clause, phrase or portion of this Ordinance
is for any reason held to be invalid or unconstitutional by the decision of any court of
competent jurisdiction, such decision shall not affect the validity of the remaining portions
thereof.
PASSED AND ADOPTED by the Mayor and Council of the Town of Marana,
Arizona, this 2151 day of March, 2000.
