AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA,
ARIZONA, APPROVING A REZONE REQUEST BY F AIRFAX MANAGEMENT, TO REZONE
APPROXIMA TEL Y 76.74 ACRES OF LAND LOCATED AT THE NORTHEAST CORNER OF
INA AND SIL VERB ELL ROADS, IN THE SOUTHERN HALF OF SECTION 35, TOWNSHIP
28 SOUTH, RANGE 12 EAST, FROM "ZONE A," TO APPROXIMATELY 27.12 ACRES OF
"ZONE VC," AND 49.62 ACRES "ZONE LI," ASSESSOR'S PARCEL NUMBERS 226-27-009J,
226-32-010B, 226-27-009H AND 226-32-011J
WHEREAS, Fairfax Management is the owner of approximately 76.74 acres ofland located
at the northeast comer of Ina and Silverbell Roads, as depicted on Exhibit A, attached hereto and
incorporated herein by this reference, and are more specifically described as in the southern half of
Section 35, Township 28 South, Range 12 East; and

WHEREAS, Fairfax Management has requested a rezone of the 76.74 acre property from
"Zone A," to approximately 27.12 acres of "Zone VC," and 49.62 acres "Zone LI," rezoning
requests more particularly described in Exhibit B, attached hereto and incorporated herein by this
reference; and
WHEREAS, in reviewing the rezoning request, Staff recommended to the Planning and
Zoning Commission the approval of the rezoning request subject to fourteen (14) conditions; and
WHEREAS, the Marana Planning Commission, after a public hearing, considered this
request for a rezone on July 26, 2000, and voted to recommend that the Town Council approve said
rezone for the purpose of providing an area of transition from the heavier industrial adjacent uses
and the provision of employment opportunities within the Town; and
WHEREAS, the Marana Town Council has determined that the rezone is in conformity with
the General Plan and should be approved.

Section 1. The zoning of approximately 76.74 acres ofland located at the northeast comer ofIna
and Silverbell roads, in the southern half of section 35, Township 28 South, Range 12 East,
Assessor's Parcel Numbers 226-27-009J, 226-32-010B, 226-27-009H and 226-32-01IJ, more
particularly described in Exhibit A, attached hereto, is hereby changed from "Zone A," to

approximately 27.12 acres of "Zone YC," and 49.62 acres "Zone LI," as more particularly described
in Exhibit B, attached hereto.
Section 2. The purpose ofthis rezoning is to provide an area oftransition from the heavier industrial
adjacent uses and the provision of employment opportunities within the Town, subject to the
following conditions:
1. Compliance with all provisions of the Town's Codes, Ordinances and policies of the General
Plan, current at the time of any subsequent development, including, but not limited to, requirements
for public 'improvements.
2. A block plat is required for this project. This rezoning is valid for three years from the date of
Town Council approval, if the developer fails to have the required Block Plat recorded prior to the
three years, the property shall revert to the original zoning without further action by the Town
Council.

3. Any Army Corps of Engineers Jurisdictional Waterways must be mapped by the Corps and shown
with the first submittal of the Development Plan or Subdivision Plat.
4. Off-site improvements to Ina Road and Silverbell Road will be required. The extent of
improvement, which may include a traffic signal at the intersection of the two arterials, will be
determined by the required TIA.
5. An Erosion Hazard Analysis, acceptable to the Town Engineer, must be approved for all
Development Plans or Subdivision Plats.
6. All driveway locations must be recommended by a Traffic Impact Analysis that addresses sight,
visibility and separation of driveway requirements, and is approved by the Development Services
Administrator.
7. All required additional rights-of-way for Silverbell and Ina Roads as well as blanket easements
for drainage structures and construction easements shall be dedicated within 90 days of zoning
approval.

8. A ~ater service agreement and master water plan must be submitted by the Developer, and
accepted by the Utilities Director, prior to the approval ofthe Block Plat by the Town Council.

9. A sewer service agreement and master sewer plan must be submitted by the Developer, and
accepted by Pima County Wastewater Management and the Town Engineer, prior to the approval
of the Block Plat by the Town Council.

10. The "VC" zoned property cannot be developed at the R-6 standards as permitted by the Town
of Marana Development Code.
11. Prior to issuance of a grading permit, clearance from Fish and Wildlife shall be submitted to the
Town.
12. The developer shall dedicate all areas that are located in the floodway to the appropriate agency
for flood control purposes.
13. The Developer shall dedicate the necessary area for trail purposes to the Town of Marana, this
includes the 50 foot buffer.
14. Prior to the issuance of the grading permit, written approval of an archeological survey and
mitigation plan by the Arizona State Museum must be submitted to the Town of Marana.

Section 3. All Ordinances, Resolutions, and Motions and parts of Ordinances, Resolutions, and
Motions of the Marana Town Council in conflict with the provisions of this Ordinance are hereby
repealed, effective as of the effective date this Ordinance.
Section 4. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any
reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction,
such decision shall not affect the validity of the remaining portions hereof.
