AN ORDINANCE EXTENDING AND INCREASING THE CORPORATE LIMITS OF THE
TOWN OF MARANA, ARIZONA, PURSUANT TO THE PROVISIONS OF TITLE 9, CHAPTER
4, ARIZONA REVISED STATUTES, AND AMENDMENTS THERETO, BY ANNEXING
THERETO THAT TERRITORY KNOWN AS THE CORTARO ROAD/I-I0 ANNEXATION,
COMPRISING THE 1-10 AND UNION PACIFIC RIGHTS-OF-WAY BETWEEN THE TOWN
BOUNDARY NEAR INA ROAD AND APPROXIMA TEL Y 400 FEET SOUTH OF THE
CORTARO FARMS ROADWA YUNDERPASS, WHICH IS CONTIGUOUS TO THE EXISTING
TOWN LIMITS OF THE TOWN OF MARANA, ARIZONA, AND CHANGING THE ZONING
OF SAID TERRITORY FROM PIMA COUNTY ZONE "RH" TO MARANA ZONE "R-144."

WHEREAS, a petition in writing, accompanied by a map or plot of said real property, having
been filed and presented to the Mayor and Council of the Town of Marana, Arizona, signed by the
owners of more than one-half in value of the real and personal property and more than one-half of
the persons owning real and personal property that would be subject to taxation by the Town of
Marana as shown by the last assessment of said property, said property being contiguous to the Town
of Marana and not now embraced within its limits, asking that the property more particularly
hereinafter described be annexed to the Town of Maran a, and to extend and increase the corporate
limits of the Town of Marana so as to embrace same; and
WHEREAS, the Mayor and Council of the Town of Marana, Arizona, are desirous of
complying with said petition and extending and increasing the corporate limits of the Town of
Marana to include said territory; and
WHEREAS, the Cortaro Road/I-I 0 Annexation is a parcel comprising the 1-10 right-of-way
and the Union Pacific Railroad Company land between the Town boundary near Ina Road and
approximately 400 feet south of the Cortaro Farms roadway underpass, consisting of approximately
101 acres in a portion of Sections 26, 35 and 3 6, Township 12 South, Range 12 East, Gila and Salt
River Meridian, Pima County, Arizona; and

WHEREAS, the petition sets forth a true and correct description of all the exterior boundaries
of the entire area proposed to be annexed to the Town of Maran a and had attached thereto at all times
an accurate map of the territory desired to be annexed; and

WHEREAS, no alterations increasing or reducing the territory sought to be annexed have
been made after the petition had been signed by any owner of real and personal property in such
territory; and

WHEREAS, A.R.S. S 9-471 (L) requires the Town to adopt transitional zoning classifications
which permit densities and uses no greater than those permitted by the County before annexation;
and
WHEREAS, the Pima County zoning classification on the property prior to annexation was
"RH" and the most comparable Town zoning classification which does not permit greater densities
and use is "R-144."
WHEREAS, the provisions of A.R.S. S 9-471 as amended have been fully observed; and
WHEREAS, proper and sufficient certification and proof of the foregoing facts are now on
file in the office of the Town Clerk of the Town of Marana, together with a true and correct copy of
the original petition referred to herein, which is on file in the office of the Pima County Recorder.
NOW THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Marana,
Arizona, that:
1. The territory known as the Cortaro RoadlI-1 0 Annexation is hereby annexed into the
Town of Marana and the present corporate limits are extended and increased to
include the described area.
2. The zoning of said territory is hereby changed from Pima County "RH" to Marana
"R-144."
3. A copy of this Ordinance, together with an accurate map of the territory hereby
annexed to the Town of Marana, certified by the Mayor, be forthwith filed and
recorded in the office of the County Recorder of Pima County, Arizona.
PASSED AND ADOPTED by the Mayor and Council of the Town of Maran a, Arizona, this
2nd day of February, 1999.

the Town of Marana, and hereby files this affidavit in compliance with A.R.S. ~9-471
(A)(6). Affiant affirms that he has conducted reasonable review and research, and has
determined that no part of the territory in the attached proposed annexation is already
subject to an earlier filing for annexation. Further, affiant sayeth not.
