OF PAGES: 3 SEQUENCE: 19991120188 06/11/1999 ORDIN 12:00 ~ SMARA TOWN OF MARANA ATTN: TOWN CLERK 13251 N LON ADAMS RD MARANA AZ 85653 MAIL AMOUNT PAID $ 8.00 MARANA ORDINANCE NO. 99.16 AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA, APPROVING A REZONE INITIATED BY THE TOWN OF THE 1-1 0 RIGHT -OF - WAY AND ADJACENT UNION PACIFIC RAILROAD PROPERTIES LOCATED WITHIN THE TOWN LIMITS, LYING IN PORTIONS OF SECTIONS 7, 8, 16, 17,21, AND 22, TOWNSHIP 11 SOUTH, RANGE 11 EAST, FROM MARANA TOWN ZONE "R-144" (SINGLE FAMILY RESIDENTIAL, MINIMUM LOT SIZE 144,000 SQUARE FEET) TO MARANA TOWN ZONE "LI" (LIGHT INDUSTRIAL). WHEREAS, on March 16,1999, the Town Council adopted Ordinance No. 99.06 approving the Northern Corridor Annexation, which is an annexation of a segment of the 1-10 and Union Pacific Railroad rights-of-way, approximately three miles in length; and ,- WHEREAS, the proposed rezone consists of the 1-10 and Union Pacific Railroad rights-of- way within the Town limits, located approximately one-half mile north of Hardin Road and extending southeasterly to Trico- Marana Road within portions of Sections 7, 8, 16, 17, 21, and 22, Township 11 South, Range 11 East; and WHEREAS, the Town of Maran a has initiated this rezone ofthe property from Marana Town Zone "R-144" (Single Family Residential, minimum lot size 144,000 square feet) to Marana Town Zone "LI" (Light Industrial); and WHEREAS, the Marana Planning Commission considered the request for a rezone on April 28, 1999, held a public hearing, and voted 6-0 to recommend that the Town Council approve the rezone; and WHEREAS, the proposed rezoning of the 1-10 and Union Pacific Railroad rights-of-way is consistent with the purpose and intent ofthe General Plan, serving to protect the 1-10 corridor from encroachment by residential uses, which may be incompatible with an interstate highway setting; and - WHEREAS, the Marana Town Council heard from the representative of the owner, staff and members of the public at the regular Town Council meeting held June 1, 1999, and has determined that the rezone should be approved. .. i .-" ~ ==:..:: ,- Marana, Arizona Ordinance 99.16 Page 1 of 2 'J, j . . -- NO W, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Maran a, Arizona, as follows: Section 1. Section 2. Section 3. The rezoning of the 1-10 and Union Pacific Railroad rights-of-way within the Town limits, located approximately one-half mile north of Hardin Road and extending southeasterly to Trico-Marana Road within portions of Sections 7,8, 16, 17,21, and 22, Township 11 South, Range 11 East, more particularly described in Exhibit A attached hereto and incorporated herein by this reference, is hereby changed from Marana Town Zone R-144 (Single Family Residential, minimum lot size 144,000 square feet) to Marana Town Zone "LI" (Light Industrial). All Marana ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions of the Town Council in conflict with the provisions of this Ordinance are hereby repealed, effective as of the effective date of this Ordinance. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
