LON ADAMS RD MARANA AZ 85653 MAIL AMOUNT PAID $ 8.00 MARANA ORDINANCE NO. 99.17 AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, APPROVING A REZONE REQUEST BY HARTMAN HARDY, L.L.c., FOR COUNTRYSIDE VISTA BLOCKS 5 AND <i, ASSESSOR'S PARCEL NUMBERS 221-10-0010 AND 221-10-0020, LOCATED IN A PORTION OF THE NORTHWEST QUARTER OF SECTION 24, TOWNSHIP 12 SOUTH, RANGE 12 EAST, FROM "ZONE R-144" (SINGLE FAMILY RESIDENTIAL, MINIMUM LOT SIZE 144,000 SQUARE FEET) TO "ZONE R-6" (SINGLE F AMIL Y RESIDENTIAL, MINIMUM LOT SIZE 6,000 SQUARE FEET) WHEREAS, on August 19, 1997, the subject property was annexed into the Town by adoption of Marana Ordinance No. 97.25 and the property was transition zoned from Pima County zone SR (Suburban Rural) to Marana Zone R-144 (Single Family Residential, minimum lot size 144,000 square feet); and WHEREAS, Hartman Hardy, L.L.c., is the owner of approximately 19.80 acres located at the southwest comer of Linda Vista Boulevard and Hartman Lane originally zoned for a large residential master- .- planned community in 1980, more specifically described as a portion of the Northwest Quarter of Section 24, Township 12 South, Range 12 East, see Exhibit A (Legal Description), on file in the office of the Town Clerk; and WHEREAS, Hartman Hardy, L.L.C. has requested a rezone of Countryside Vista Blocks 5 and 6 from "Zone R-144" (Single Family Residential, minimum lot size of 144,000 square feet) to "Zone R-6" (Single Family Residential, minimum lot size of 6,000 square feet); and WHEREAS, the Marana Planning Commission, after a public hearing, considered this request for a rezone on April 28, 1999, and voted unanimously to recommend that the Town Council approve said rezone; and WHEREAS, the Marana Town Council heard from the representative of the owner, staff and members of the public at the regular Town Council meeting held July 6, 1999, and has determined that the rezone is in conformity with the General Plan and should be approved. i NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Marana, Arizona, as follows: ~ ,- Section 1. The zoning of approximately 19.80 acres located in the Northwest Quarter Section 24, Township 12 South, Range 12 East, Assessor's Parcel Numbers 221-10-0010 and 221-1 0-0020, is hereby changed from "Zone R-144" (Single Family Residential, minimum lot size of 144,000 square feet) to "Zone R-6" (Single Family Residential, minimum lot size of 6,000 square feet), subject to the following conditions: 1. An on-the-ground survey for cultural remains prior to any ground modifications subject to the approval of the Arizona State Museum. 2. The dedication of additional right-of-way for Hartman Lane to accommodate a half right-of-way of 50 feet. 4. No asphalt shingled roof shall be allowed. 5. No roof mounted mechanical equipment shall be allowed. 6. Lots shall be a minimum of 5,000 square feet. Section 2. The purpose ofthis rezoning is to allow for the development of a 1 05-10t single family residential subdivision, which includes approximately 2.3 acres of open space of which at least 41 ,200 square feet, will be developed as a recreation area, see Exhibit B (Map), on file in the office of the Town Clerk. Section 3. All Ordinances, Resolutions, and Motions and parts of Ordinances, Resolutions, and Motions of the Marana Town Council in conflict with the provisions of this Ordinance are hereby repealed, effective as of the effective date of Ordinance No. 99.17. Section 4. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions hereof. Section 5. On file in the office of the Town Clerk of the Town of Marana, Arizona, are those certain documents, known as Exhibits A and B, which are recorded and hereby referred to, adopted, and made a part of Ordinance No. 99.17.
