CAMINO MARTIN IN SECTION 6, TOWNSHIP 13 SOUTH, RANGE 13 EAST, FROM "R-36" (SINGLE FAMILY RESIDENTIAL, MINIMUM LOT SIZE OF 36,000 SQUARE FEET) TO "HI" (HEAVY INDUSTRIAL), ASSESSOR'S PARCEL NUMBER 101-05-015B. WHEREAS, John and Tracy Gutierrez, are the owners of approximately 3.7 acres of land located at 6800 N. Camino Martin, as depicted on Exhibit "A", attached hereto and incorporated herein by this reference, and more specifically described as Section 6, Township 13 South, Range 13 East; and WHEREAS, in reviewing the rezoning request, Staff recommended to the Planning and Zouing Commission the approval of the rezoning request subject to six conditions; and WHEREAS, the Marana Planning Commission, after a public hearing, considered this rezoning request on January 30, 2002, and voted 4-2 to recommend that the Town Council approve said rezone, adopting all six recommended staffconditions; and, WHEREAS, the Marana Town Council heard from representatives of the owners, staffand members of the public at the regular Town Council meeting held March 19, 2002, and has determined that the rezoning is in conformity with the General Plan and should be approved. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Marana, Arizona, as follows: Section 1. The zoning of approximately 3.7 acres located at 6800 N. Camino Martin in Section 6, Township 13 South, Range 13 East, is hereby changed fi-om "R-36" (Single Family Residential, minimum lot size of 36,000 square feet) to "HI" (Heavy Industrial), Assessor's Parcel Number 101- 05-015B. Section 2. The purpose of this rezoning is to integrate the subject parcel into one cohesive development, subject to the following conditions: 1. Compliance with all provisions of the Town's Code and Ordinances, including, but not limited to, requirements for public improvements. 2. This rezoning is valid for three years form the date of Town Council approval, if the Developer fails to have a subdivision plat recorded or development plan approved, prior to Marana Ordinance No. 2002.05 Page 1 the three years, the property shall revert to the original zoning without further action by the Town Council. 3. The Developer shall dedicate to the Town of Marana the necessary land needed to create an acceptable sized cul-de-sac for the terminus of Camino Martin, prior to the Town accepting the Development Plan. 4. The Developer shall dedicate to the property owner of Assessor Parcel Number 101-05- 043K a private ingress/egress easement with maintenance agreement prior to the Town accepting the Development Plan. 5. The Developer shall improve Camino Martin Road to Town standards from its current end of pavement at New West Drywall south including the Cul-de-sac, as a part of the improvements for the development plan. 6. A sewer service agreement must be submitted, by the Developer, and accepted by Pima County Wastewater management prior to approval of the development plan or preliminary plat. Section 3. All Ordinances, Resolutions and Motions and parts of Ordinances, Resolutions, and Motions of the Marana Town Council in conflict with the provisions of this Ordinance are hereby repealed, effective as of the effective date of Ordinance No. 2002.05. Section 4: If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions hereof.
