OF PAGES: 3 SEQUENCE: 20021730934 09/06/2002 ORDIN 16:29 MAIL AMOUNT PAID $ 8.00 MARANA ORDINANCE NO. 2002.17 AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA, ARIZONA, APPROVING A REZONE OF THE PROPERTY LOCATED WITHIN THE TOWN LIMITS AT 4340 W. INA ROAD, APPROXIMATELY 100 FEET EAST OF ULENE PLACE ON THE NORTH SDE OF INA ROAD, FROM ZONE "R-8" (RESIDENTIAL, 8,000 SQUARE FOOT MINIMUM LOT), TO "CO" (COMMERCIAL) WHEREAS, DMN Ltd. Parmership owns approximately 8,065 square feet of property (Assessor Parcel Number 225-37-3750), in a portion of Section 31, Township 12 South, Range 13 East, more particularly described in Exhibit A attached hereto; and WHEREAS, DMN Ltd. Partnership has applied to the Town to have the property rezoned from "R-8" (Residential, 8,000 square foot minimum lot) to "CO" (Commercial) due to the location in a commercial area of Ina Road; and , WHEREAS, the Marana Planning and Zoning Commission held a public hearing on June 26, 2002, and voted 5-1 (Parker dissenting), to recommend that the Town Council approve the rezone; and WHEREAS, the Town Council held a public hearing on September 3, 2002, to obtain input from the Applicant, Town Staff, and the public on the rezoning of the Property, and has determined tha~ the rezone is in the best interest of the residents and the Town of Marana and should therefore be approved. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Towm of Mararra; Arizona, as follows: Section 1: The DMN Ltd. Partnership property, Assessor Parcel Number 225-37-3750 is hereby changed (rezoned) from R-8 (Residential, 8,000 sq. ft. minimum lot area) to "CO" (Commercial); Section 2: : The purpose of this rezoning is to allow for commercial office use on a parcel that fronts onto Ina Road, that will promote the health, safety and general welfare of the Town, subject to the following condition: Compliance with all provisions of the Town's Code and Ordinances, including, but not limited to, requirements for public improvements. t 8 ? 9 --P'age 1 of 2-- Section 3: All Marana ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions of the Town Council in conflict with the provisions of this Ordinance are hereby-repealed effective as of the effective date of this Ordinance. Section 4: If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
