This document, Marana Ordinance No. 2002.20, recorded by the Pima County
Recorder on October 29, 2002, in Docket 11915, Pages 0158 and 0159, was
recorded in error and shall be deemed null and void. It was originally brought
before the Marana Town Cotmcil on October 15, 2002 but was not approved at
that time. A continuance was approved and the agenda item was rescheduled for
the November 5, 2002 Town Council meeting. At that time, Ordinance No.
2002.20 was resubmitted to the Town Council for approval and was
subsequently recorded on November 8, 2002, in Docket 11923, Pages 3531 and
3532. With the exception of approval dates and signatures, the text is identical in
both ordinances. The latter ordinance, signed by Vice Mayor Herbert KaL shall
be deemed the true and correct ordinance associated with the Town Council
action regarding an amendment to the Marana Land Development Code, Title 6,
Subdivision Requirements.

AN ORDINANCE OF THE MAYOR AND COUNCLL OF THE TOWN OF MARANA,
ARIZONA, AMENDING TITLE 6, SUBDIVISION REQUIREMENTS, OF THE MARANA LAND
DEVELOPMENT CODE, DEALING WITH SUBDIVISIONS REQUIREMENTS, PROCESSING,
DESIGN STANDARDS AND ADDING MINOR LAND DIVISIONS AND OTHER VARIOUS
ISSUES AND REPEALING ALL RESOLUTIONS, ORDINANCES, AND RULES OF THE
TOWN OF MARANA IN CONFLICT THEREWITH.
WHEREAS, the Mayor and Council of the Town of Marana did, on May 14, 1984, approve
Ordinance Number 84.04, thereby adopting a Land Development Code (the "Code") for the Town of
Marana; and
WHEREAS, the Mayor and Council have amended the Code from time to time; and
WHEREAS, the Code contains Title 6, Subdivision Requirements, Which respectively
provide regulations for subdividing lands within the Town of Marana; and
WHEREAS, the Marana Planning Commission held a public hearing on a request to amend
Title 6 of the Code on August 28, 2002, and its members voted to recommend approval of the
proposed amendments to the Town Council by a unanimous vote; and
WHEREAS, the Town Council held a public hearing on the request to amend Title 6 of the
Code on October 15, 2002, to obtain input from town staff and the public on the proposed
amendments; and '
WHEREAS, the Mayor and Council find that approval of the proposed amendments is in the
best interests of the residents and the businesses of the Town of Marana.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Marana,
Arizona, as follows:
Section 1' Title 6 of the Marana Land Development Code is hereby amended by deleting
the existing text and substituting therefor that certain document entitled "Title 6 - Subdivisions of the
Marana Land Development Code," three copies of which are on file in the office of the Town Clerk
of the Town of Marana, Arizona, having been declared a public record by adoption of Resolution
2002-116.
Section 2: Title 6 of the Marana Land Development Code is hereby amended by deleting
the existing text and reserving the title for future use.

_Section 3: The various town o fficers and employees are authorized and directed to
perfom~ all acts necessary or desirable to give effect to this Ordinance and portion of the Code.
Section 4: All ordinances, resolutions, or motions and parts of ordinances, resolutions, or
motions of t he Council i n conflict with t he provisions o f t his Ordinance a re hereby repealed,
effective as of the effective date of this Ordinance.
Section 5: If any section, subsection, sentence, clause, phrase or portion of this Ordinance
is for any reason held to be invalid or unconstitutional by the decision of any court of competent
.jur/sdiction, such decision shall not affect the validity of the remaining portions hereof.
PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona, this
15th day of October, 2002.
