OF PAGES: 2 SEQUENCE: 20021950038 10/08/2002 ORDIN 09:43 MAIL AMOUNT PAID $ 8.00 MARANA ORDINANCE NO. 2002.21 AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA, AMENDING SECTION 3-4-5 OF THE TOWN CODE, RELATING TO PURCHASING. WHEREAS, A.R.S. § 9-240(A) grants the Town Council of the Town of Marana control of the finances of the Town; and WHEREAS, the Town Council did approve Ordinance No. 2000.07, which adopted numerous changes to Chapter 3 of the Town Code entitled "Administration"; and WHEREAS, the Town Council has amended the Town Code from time to time; and WHEREAS, Section 3-4-5 of the Town Code requires purchases of$14,0(J0.00 or more to be submitted to a competitive sealed bidding process; and WHEREAS, the Mayor and Council of the Town of Marana have determined that requiring competitive sealed bidding for purchases of$10,000.00 or more wilt conserve public funds and give the Council greater control over the budget of the Town; and WHEREAS, the Mayor and Council have determined that conserving public funds is in the best interest of the Town and its residents; and WHEREAS, an amendment of Section 3-4-5 of the Town Code is necessary to change the limit for purchases not submitted to competitive sealed bidding from $14,000.00 to $10,000.00. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Marana, Arizona, as follows: Section 1. Section 3-4-5 of the Town Code is hereby amended by substituting"$10,000.00" for each occurrence of"$14,000.00" throughout the section. Section 2. The various town officers and employees are authorized and directed to perform all acts necessary or desirable to give effect to this ordinance and portion of the Town Code. All ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions of the council in conflict with the provisions of this ordinance are hereby repealed, effective as of the effective date of this ordinance. Section 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
