AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA, AMENDING ARTICLE 3-4 OF
THE TOWN CODE, RELATING TO DISPOSAL OF OBSOLETE PROPERTY.
WHEREAS, A.R.S. § 9-240(A) grants the Town Council of the Town of Marana control of the
finances and property of the Town; and
WHEREAS, the Town Council did approve Ordinance No. 2000.07, which adopted numerous
changes to Chapter 3 of the Town Code entitled "Administration"; and
WHEREAS, the Town Council has amended the Town Code from time to time; and
WHEREAS, Section 3-4-3 of the Town Code designates the Town Manager as the purchasing
agent for the Town; and
WHEREAS, Section 3-4-12 of the Town Code authorizes the purchasing agent for the Town to
dispOse of property that is no longer of use to the Town by selling it, or by exchanging or trading it for
property that is of use to the Town; and
WHEREAS, the Mayor and Council of the Town of Marana have deternfined that the purchasing
agent for the Town should be given the greatest possible flexibihty in disposing ofpropertX that is no lon_ger
useful to the Town, without providin~ for the potential for abuse of that authority; and
WHEREAS, the Mayor and Council have determined that amending Sections 3-4-3 m~d 3-4-12
of the Town Code to prOvide for greater flexibility in disposing of obsolete property is in the best interest
of the Town and its residents.
NOW, THEREFORE, BE IT ORDAINED bythe Mayor and Council of the Town of Marana,
A.rizona, as follows:
Section 1. Section 3-4-3 of the Town Code is hereby amended by substituting "finance director" for
each occurrence of "town manager" throughout the section.
Section 2. Section 3-4-12 of the Town Code is hereby amended to read as follows:

Obsolete Supplies and Equipment
All departments and offices Shall submit to the purchasing agent, at such time and in such form as
shall be prescribed, reports showing all supplies and equipment that have become obsolete. The
purchasing agent shall have the authority to dispose of all supplies and equipment that have become
obsolete, with the approval of the town manager.
Section 3. The various town officers and employees are authorized and directed to perform all acts
necessary or desirable to give effect to this ordinance and portions of the Town Code.
Section 4. All ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions of
the council in conflict with the provisions ofth/s ordinance are hereby repealed, effective as of the effective
date of this ordinance.
Section 5. If any section, subsection, sentence, clause, phrase orportion of this ordinance is for any
reason held to be invalid or unconstitutional bythe decision ofanycourt ofcompetehtjurisdiction, such
decision shall not affect the validity of the remaining portions thereof.
PASSED AND ADOPTED bythe Mayor and Council of the Town of Marana, Arizona, this 1 st
day of October, 2002.
