AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA, AMENDING SECTION 2-1-8 OF
THE TOWN CODE, RELATING TO COMPENSATION FOR COUNCIL MEMBERS.
WHEREAS, the Town Council did approve Ordinance No. 96.13, which adopted Chapter
2 of the Town Code, entitled "Mayor and Council"; and
WHEREAS, the Town Council has amended the Town Code from time to time; and
WHEREAS, Section 2-1-8 of the Town Code provides that the Mayor and Council of the
Town of Marana shall receive no compensation for performing their official duties; and
WHEREAS, with the increased growth of the Town, the official duties of the Mayor and
Council have come to consume increasing mnounts of their time, interfering with their ability to earn
a reasonable living; and

WHEREAS, the Mayor and Council have determined that providing fair compensation for
serving in office would allow the members of the Town Council to devote more time to performing
their official duties; and
WHEREAS, the Mayor and Council have determined that devoting more time to performing
their official duties is in the best interest of the Town and its residents; and
WHEREAS, the Mayor and Council have determined that historically very few individuals
have sought election to the Town Council; and
WHEREAS, the Mayor and Council have determined that due to the time commitment of-
serving on the Town Council, few qualified candidates are willing and able to serve; and
· WHEREAS, the Mayor and Council have determined that, as the complexity of the duties
performed by the members of the Town Council and the time required to perform those duties have
increased, the prospect of compensation has become a critical issue for potential candidates; and
WHEREAS, the Mayor and Council have determined that offering compensation to the
members of the Town Council will attract greater numbers of qualified candidates for positions on
the Council; and
WHEREAS, the Mayor and Council have determined that increasing the number of qualified
candidates who seek positions on the Town Council is in the best interest of the Town and its
residents; and

WHEREAS, the Mayor and Council have determined that, due to the demands placed on
their elected officials, other municipalities in Arizona, including the City of Tucson and the Town
of Oro Valley, have provided salaries to their mayors and council members; and
WHEREAS, State law prohibits the Town Council from referring the issue of whether to pay
the Mayor and Council to the Town's electors; and
WHEREAS, A.R.S. § 9-232.01 grants the Town Council the authority to approve a salary
for the Mayor and Council Members.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of
Marana, Arizona, as follows:
Section 1. Section 2-1-8 of the Town Code is hereby amended by deleting the existing text and
inserting the following text:
Section 2-1-8 Compensation
The compensation of elective officers of the Town shall be fixed from time to time by
resolution of the Council.
Section 2. The various town officers and employees are authorized and directed to perform all
acts necessary or desirable to give effect to this ordinance and portion of the Town Code.

Section 3. All ordinances, resolutions, or motions and parts of ordinances, resolutions, or
motions of the council in conflict with the provisions of this ordinance are hereby repealed, effective
as of the effective date of this ordinance.
Section 4. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for
any reason held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
