AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA, AMENrDING CHAPTER 10
(HEALTH AND SANITATION) OF THE TOWN CODE, RELATING TO TRANSPORTATION OF
AGGREGATE MATERIAL.
WHEREAS, the Town Council of the Town of Marana did approve Ordinance No. 2002.06,
which established regulations for vehicles transporting aggregate material through the Town; and
WHEREAS, the Mayor and Council of the Town of Marana have amended the Town Code from
time to time; and
WHEREAS, the Mayor and Council have determined that amending the existing regulations is
necessary to revise some of the language contained therein; and
WHEREAS, the Mayor and Council have detemdned that revising the Town's regulations for the
transportation of aggregate material through the Town is in the best interest of the Town and its residents.
NOW, THEREFORE, BE IT ORDAINED, bythe Mayor and Council of the Town of Marana,
Arizona, as follows:
Section 1. Section 10-1-1 (C)(4) of the Town Code ("Definitions") shall be amended by deleting the
existing text and replacing it with the following language:
4. A cover, tarpaulin or other device which prevents the load from becoming loose,
detached or in any manner a hazard to other users of the roadway, public
thoroughfare or right-of-way.
Section 2. Section 10-1-203) of the Town Code ("Transportation of garbage or aggregate material")
shall be amended by adding the following language:
4. Equipment employed in agricultural or husbandry activities.
Section 3. Section 10-1-2(D) ofthe Town Code ("Transportation of garbage or aggregate material")
shall be amended by deleting the existing text and replacing it with the following language:
D. Vehicles transporting aggregate material within the town limits shall be equipped with the
following equipment:

Splash flaps shall be maintained behind every tire or set of tires.
Fenders on commercial trailers shall not be removed or disabled.
Section 4. It shall be a civil infraction for any person, firm or corporation to violate any of the
provisions of this Ordinance. Civil infractions shall be enforced through the hearing officer procedure
provided for by A.R.S. 9-462.08. Penalties for civil infractions shall not exceed the maximum penalty set
forth in A.R.S. 9-240.28. Each day a violation continues shall be considered a separate offense.
Section 5. The various town officers and employees are authorized and directed to perform all acts
necessary and desirable to give effect to this Ordinance and portion of the Town Code.
Section 6. If any section, subsection, sentence, clause, phrase orportion of this Ordinance is for any
reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such
decision shall not affect the validity of the remaining portions hereof.
PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona, this 17th
day of December, 2002.
