HomeMy WebLinkAboutOrdinance 98.14 Amending chapter 10 of the town code relating to litter f!~"-'" MARANA ORDINANCE NO. 98.14 AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA, AMENDING CHAPTER 10, HEALTH AND SANITATION, OF THE TOWN CODE OF THE TOWN OF MARANA BY AMENDING ARTICLE 10-2 REMOVAL OF LITTER AND ARTICLE 10-6 PENAL TIES AND REPEALING ALL RESOLUTIONS, ORDINANCES, AND RULES OF THE TOWN OF MARANA IN CONFLICT THEREWITH. WHEREAS, the Town Council of the Town of Marana, Arizona, did, on March 19,1996, adopt Ordinance No. 96.15, which adopted that certain document entitled "Marana Town Code, Chapter 10, Health and Sanitation," as the tenth chapter of the official Town Code; and WHEREAS, the Town Council deems it necessary to amend Chapter 10, and more specifically, Article 10-2 Litter on Private Premises or Public Place and Article 10-6 Penalties to further specify the penalties for dumping litter on any public place or private premises within the town; and ,,~ WHEREAS, the Mayor and Council of the Town of Marana have determined that the adoption of such regulations is in the best interests of the citizens of the Town of Mar ana. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Marana, Arizona, as follows: Section 1. Article 10-2, Removal of Litter, of the Marana Town Code is amended, with additions shown by CAPITAL LETTERS and deletions shown by strikeout, as follows: Section 10-2-2 Litter on Private Premises or Public Place No person shall DUMP, throw or deposit litter on any public place or private premises within the town, whether owned by such person or not, except that the owner or person in control of private premises may maintain authorized private receptacles for refuse in such a manner that litter will be prevented from being carried or deposited by the elements upon any public place. Any person violating the provisions of this section shall be liable for any costs assessed for removal of such litter. Marana, Arizona Ordinance No. 98.14 Page 1 of 3 Section 2. Article 10-6, Penalties, ofthe Marana Town Code is amended, with additions shown by CAPITAL LETTERS and deletions shown by 5t1ikGout, as follows: Section 10-6-1 General Notwithstanding any criminal penalties as prescribed under Title 13, Arizona Revised Statutes, a violation of any portion of this chapter except as outlined below is a civil offense punishable by a civil sanction of not more than $500.00. Each day the violation continues shall constitute a separate and distinct offense. SECTION 10-6-2 VIOLATIONS IN ADDITION TO THE PROVISIONS FOR COMPELLING REMOVAL LISTED IN SECTIONS 10-2-5 THROUGH 10-2-9, A VIOLATION OF ANY PROVISION OF SECTIONS 10-2-2 OR 10-2-3 IS A CLASS 2 MISDEMEANOR. Section 10-6-2 SECTION 10-6-3 Travel Reduction ,,~ A violation of any provision of article 10-4 of this chapter is a petty offense. Each day the violation continues shall constitute a separate and distinct offense. Section 3. The various Town officers and employees are authorized and directed to perform all acts necessary or desirable to give effect to this ordinance. Section 4. All Marana ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions ofthe council in conflict with the provisions ofthis ordinance are hereby repealed, effective as of the effective date of this ordinance. Section 5. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
