HomeMy WebLinkAboutOrdinance 98.15 Amending chapter 2 of the town code relating to mayor and council '\ ,~~ MARANA ORDINANCE NO. 98.15 AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA, AMENDING CHAPTER 2, MAYOR AND COUNCIL, OF THE TOWN CODE OF THE TOWN OF MARANA, BY AMENDING SECTION 2-2-6, INITIATIVE AND REFERENDUM, AND REPEALING ALL RESOLUTIONS, ORDINANCES, AND RULES OF THE TOWN OF MARANA IN CONFLICT THEREWITH, AND DECLARING AN EMERGENCY TO EXIST. WHEREAS, on March 5, 1996, the Town Council did approve Ordinance No. 96.13, which adopted that certain document entitled "Marana Town Code, Chapter 2, Mayor and Council," as the second chapter of the official Town Code; and WHEREAS, in order to comply with state law, the Council deems it necessary to amend the time frame one has to file an argument supporting or opposing municipal initiative and referendum measures, which shall be filed with the Town Clerk not less than sixty (60) days before the election at which they are to be voted upon, pursuant to A.R.S. gI9-141(B); and ",- WHEREAS, the Mayor and Council of the Town of Marana have determined that the incorporation of such amendment into the Town Code to bring it into compliance with the Arizona Revised Statutes is in the best interests of the citizens of the Town of Marana. NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Marana, Arizona, as follows: Section 1. Section 2-2-6 of the Marana Town Code is hereby amended as follows, with additions being shown in CAPITAL LETTERS and deletions being shown in strikeout text: Section 2-2-6 Initiative and Referendum D. Sample Ballots and Publicity Pamphlets The following procedures relating to sample ballots and publicity pamphlets are hereby adopted for conducting elections at which an initiative or referendum is to be voted upon: 3. Arguments supporting and opposing propositions appearing on the ballot shall be filed with the office of the town clerk by 5:00 p.m. not less than thirty SIXTY days prior to the election at which the propositions are to be Marana, Arizona Ordinance No" 98J5 Page 1 of 2 ~".-...... Arguments supporting or opposing propositions appearing on the ballot shall meet the following requirements: The various Town officers and employees are authorized and directed to perform all acts necessary or desirable to give effect to this ordinance. All Marana ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions ofthe council in conflict with the provisions ofthis ordinance are hereby repealed, effective as of the effective date of this ordinance. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof. The immediate operation of this Ordinance is necessary for the preservation of the public peace, health and safety of the Town of Marana, Arizona, an emergency is hereby declared to exist, and this Ordinance shall be in full force and effect from and after its passage and adoption.
