HomeMy WebLinkAboutOrdinance 98.23 Amending personnel policy revisions MARANA ORDINANCE NO. 98.23 AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA, AMENDING AND APPROVING THE TOWN OF MARANA PERSONNEL POLICY REVISIONS AND REPEALING ALL RESOLUTIONS, ORDINANCES, AND RULES OF THE TOWN OF MARANA IN CONFLICT THEREWITH. WHEREAS, on May 18, 1983, the Town Council passed Ordinance No. 83.05, which adopted the Town of Marana Personnel Policies; and WHEREAS, on December 20, 1989, the Town Council passed Ordinance No. 89.32, which amended the Town of Marana Personnel Policies and rescinded all previous ordinances in conflict therewith; and WHEREAS, the Town Council ofthe Town of Marana has determined that it would be in the best interests for the efficient administration of the Town to amend those policies as more particularly set forth herein. ~ NOW, THEREFORE BE IT ORDAINED by the Mayor and Council ofthe Town of Maran a Arizona, as follows: Section 1. That Chapter 3, Classification and Pay, of the Town of Marana Personnel Policies is hereby amended, with additions shown in CAPITAL LETTERS and deletions shown by strikeout, as follows: POLICY 3-1 CLASSIFIED AND UNCLASSIFIED SERVICE THE TOWN OF MARANA SERVICE IS DIVIDED INTO UNCLASSIFIED AND CLASSIFIED SERVICE. SECTION 3-1-1 CLASSIFIED POSITIONS ALL EMPLOYEES OF THE TOWN NOT SPECIFICALL Y LISTED AS UNCLASSIFIED EMPLOYEES SHALL BE P ART OF THE CLASSIFIED SERVICE AND ARE GOVERNED BY THE TOWN PERSONNEL POLICIES FOR DIRECTION AND EMPLOYMENT PROTECTIONS. SECTION 3-1-2 UNCLASSIFIED POSITIONS UNCLASSIFIED EMPLOYEES ARE PART OF A MANAGEMENT TEAM DESIGNED TO CARRY OUT THE GOALS AND POLICIES OF Marana, Arizona Ordinance 98.23 Page 1 of 3 Section 2. Section 3. ",--., THE TOWN. THEY ARE "AT-WILL" EMPLOYEES AND ARE NOT GOVERNED BY THE TOWN PERSONNEL POLICIES. A. UNCLASSIFIED, "AT-WILL" EMPLOYMENT IS DEFINED AS EMPLOYMENT THAT MAY BE TERMINATED UPON THE WILL OF THE EMPLOYER OR EMPLOYEE, AT ANY TIME WITH OR WITHOUT CAUSE. UNCLASSIFIED EMPLOYEES HAVE NO EMPLOYMENT CONTRACT, IMPLIED OR EXPLICIT, ARE NOT GUARANTEED ANY MINIMUM LENGTH OF EMPLOYMENT AND DO NOT HAVE ACCESS TO THE GRIEV ANCE PROCEDURE OR ARBITRATION PROCEDURES. B. UNCLASSIFIED EMPLOYEES ARE NOT SUBJECT TO THE SALARY SCHEDULE BUT ARE PAID FOR PERFORMANCE AND QUALIFICATIONS. UNCLASSIFIED EMPLOYEES ARE ELIGIBLE FOR GENERAL SALARY INCREASES APPROVED FROM TIME TO TIME BY THE TOWN COUNCIL. C. THE FOLLOWING ARE UNCLASSIFIED EMPLOYEES: 1. TOWN MANAGER 2. TOWN CLERK/TOWN MARSHALL 3. TOWN ATTORNEY 4. TOWN MAGISTRATE 5. TOWN ENGINEER 6. BUDGET AND FINANCE DIRECTOR 7. BUILDING OFFICIAL 8. CHIEF OF POLICE 9. HUMAN RESOURCES DIRECTOR 10. PARKS AND RECREATION DIRECTOR 11. PLANNING DIRECTOR 12. PUBLIC WORKS DIRECTOR 13. UTILITIES DIRECTOR 14. ALL OTHER DEPARTMENT DIRECTORS The various Town officers and employees are authorized and directed to perform all acts necessary or desirable to give effect to this ordinance. All Marana ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions ofthe Council in conflict with the provisions ofthis ordinance are hereby repealed, effective as of the effective date of this ordinance. Ifany section, subsection, sentence, clause, phrase or portion of this ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
