HomeMy WebLinkAboutOrdinance 98.24 Approving a rezone request by sharpe and associates MARANA ORDINANCE NO. 98.24 AN ORDINANCE OF THE TOWN OF MARANA, ARIZONA, APPROVING A REZONE REQUEST BY SHARPE & ASSOCIATES FOR APPROXIMATELY TEN (10) ACRES LOCATED ON THE WEST SIDE OF HARTMAN LANE AND NORTH OF CORTARO FARMS ROAD IN THE SOUTHEAST QUARTER OF SECTION 23, TOWNSHIP 12 SOUTH, RANGE 12 EAST FROM "ZONE C" TO "ZONE R-36," ASSESSOR'S PARCEL NUMBER 221-06-31. WHEREAS, Sharpe & Associates is the owner of approximately ten (10) acres located on the west side of Hartman Lane approximately three-quarters of a mile north of Cortaro Farms Road and south of Overton Road, which is more specifically described as the Southeast Quarter of the Northeast Quarter ofthe Southeast Quarter of Section 23, Township 12 South, Range 12 East; and WHEREAS, Environmental Engineering Consultants, on behalf of Sharpe & Associates, has requested a rezone ofthe property from "Zone C" (Large Lot Zone) to "Zone R-36" (Single Family Residential with a minimum lot area of 36,000 square feet) for the purpose of developing a 9-lot - residential subdivision; and WHEREAS, the Marana Planning Commission considered the request for a rezone on July 29, 1998 and voted 5-1 to recommend that the Town Council approve said rezone; and WHEREAS, the Marana Town Council heard from the representative ofthe owner, staff and members of the public at the regular Town Council meeting held October 6, 1998 and has determined that the rezone is in conformity with the General Plan and should be approved. NOW, THEREFORE BE IT ORDAINED by the Mayor and Council of the Town ofMarana Arizona, as follows: Section 1. The zoning of approximately ten (10) acres located on the west side of Hartman Lane and north ofCortaro Farms Road in the Southeast Quarter of Section 23, Township 12 South, Range 12 East, Assessor's Parcel Number 221-06-31, and more particularly described in Exhibit A attached hereto, is hereby changed from "Zone C" (Large Lot Zone) to "Zone R-36" (Single Family Residential with a minimum lot area of 36,000 square feet) for the purpose of developing a 9-lot residential subdivision subject to the Developer dedicating an additional fifty feet (50') of right- of-way for Hartman Lane. Section 2. All Marana ordinances, resolutions, or motions and parts of ordinances, resolutions, or motions ofthe Town Council in conflict with the provisions ofthis Ordinance are hereby repealed, effective as of the effective date of this Ordinance. ,,,""-' Marana, Arizona Ordinance 98.24 Page 1 of 2 Section 3. If any section, subsection, sentence, clause, phrase or portion ofthis ordinance is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions thereof.
