MARANA ORDINANCE NO. 97.03
AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA,
ARIZONA, CHANGING THE ZONING OF CERTAIN PROPERTY OWNED BY DAVID T.
COX AND LOCATED ON THE WEST SIDE OF TORTOLITA ROAD AND APPROXIMATELY
Ih MILE NORTH OF MOORE ROAD FROM "ZONE C" (LARGE LOT ZONE, MINIMUM LOT
SIZE 25 ACRES) TO "ZONE R-8" (SINGLE FAMILY RESIDENTIAL, MINIMUM LOT SIZE
8,000 SQUARE FEET).
WHEREAS, David T. Cox is the owner of approximately 40 acres ofland located on the west
side ofTortolita Road and approximately Ih mile north of Moore Road, within the southeast 1/4 of
the northeast 1/4 of section 26 township 11 south, range 12 east, Assessor's Parcel Numbers 218-44-
023A, 023B, 0024 and 0025; and
WHEREAS, the owner through the applicant, The Planning Center, has applied to the Town
of Maran a to change the zoning of the property from "Zone C" (Large Lot Zone, minimum lot size
25 acres) to "Zone R-6" (Single Family Residential Zone, minimum lot size 6,000 square feet); and
WHEREAS, the rezone is requested in order to develop 164 single family residential lots
which will include several small neighborhood parks and open spaces; and

WHEREAS, the Marana Planning Commission held a public hearing on the rezoning request
on November 20, 1996, and following this public hearing voted 3-2 to recommend that the Town
Council approve the request for rezoning of the property, with conditions, from "Zone C" (Large Lot
Zone, minimum lot size 25 acres) to "Zone R-12" (Single Family Residential Zone, minimum lot size
12,000 square feet); and
WHEREAS, the Town Council of the Town ofMarana held a public hearing on the rezoning
request on March 4, 1997, to obtain public input on the request for a change of zoning, and heard
from staff, the representative of the owner, and members of the public and has determined that the
rezoning request should be approved, with conditions.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Mar ana,
Arizona that:
Section 1. The zoning of approximately 40 acres ofland located on the west side of Tortolita
Road and approximately 1f2 mile north of Moore Road, and more particularly described in Exhibit A
attached hereto, is hereby changed from "Zone C" (Large Lot Zone, minimum lot size 25 acres) to
"Zone R-8" (Single Family Residential, minimum lot size 8,000 square feet), subject to the following
conditions:
1. The residential density of the property shall not exceed four (4) residences per acre;

2.
Right-of-way dedication for Tortolita Road shall be provided by the Developer per the
requirement of the Traffic Impact Analysis at the preliminary plat stage, as accepted by the
Town Engineer;
3. The Developer shall contribute to improvements for off-site public roads as part of any
development phase which would lower the level of service of any of those facilities to "D"
(approaching unstable flow), which is to be addressed in the required Traffic Impact Analysis;
4. A master water plan must be accepted by the Water Utilities Director prior to the approval
of the preliminary plat by the Town Council; and
5. A master sewer plan must be accepted by Pima County Wastewater Management and the
Town Engineer prior to the approval of the preliminary plat by the Town Council.
Section 2. All Marana ordinances, resolutions, or motions and parts of ordinances, resolutions,
or motions of the Council in conflict with the provisions of this ordinance are hereby repealed,
effective as of the effective date of this ordinance.
Section 3. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for
any reason held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the remaining portions thereof
