MARANA ORDINANCE NO. 97.06
AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA,
ARIZONA, CHANGING THE ZONING OF CERTAIN PROPERTY OWNED BY LV
PROPERTIES AND WESTERN FINANCIAL AND LOCATED AT THE SOUTHEAST CORNER
OF MOORE ROAD AND CAMINO DE OESTE, WITHIN THE NORTHWEST 1/4 OF THE
NORTHWEST 1/4 OF TOWNSHIP 11 SOUTH, RANGE 13 EAST, SECTION 31, FROM "ZONE
C" (LARGE LOT ZONE, MINIMUM LOT SIZE 25 ACRES) TO "ZONE R-8" (SINGLE FAMILY
RESIDENTIAL, MINIMUM LOT SIZE 8,000 SQUARE FEET) AND "ZONE YC" (VILLAGE
COMMERCIAL).
WHEREAS, L Y Properties and Western Financial are the owners of approximately 33.5 acres
ofland located on the west side of the southeast corner of Moore Road and Camino de Oeste, within
the northwest 1/4 of the northwest 1/4 of township 11 south, range 13 east, section 31, Assessor's
Parcel Number 219-34-004; and
WHEREAS, the owner, through the applicant, Winters and Associates, Inc., has applied to
the Town of Maran a to change the zoning of the property from "Zone C" (Large Lot Zone, minimum
lot size 25 acres) to "Zone R-6" (Single Family Residential Zone, minimum lot size 6,000 square feet)
and "Zone VC" (Village Commercial); and
WHEREAS, the rezone is requested in order to develop 90 detached single family residential
lots along with a commercial development, including a large supermarket; and
WHEREAS, the Marana Planning Commission held a public hearing on the rezoning request
on November 20, 1996, and following this public hearing voted 5-0 to recommend that the Town
Council approve the request for rezoning of the property, with conditions, located at the southeast
corner of Moore Road and Camino de Oeste, within the northwest 1/4 of the northwest 1/4 of
township 11 south, range 13 east, section 31, from "Zone C" (Large Lot Zone, minimum lot size 25
acres) to "Zone R-36" (Single Family Residential Zone, minimum lot size 36,000 square feet) and
"Zone VC" (Village Commercial); and
WHEREAS, the Town Council ofthe Town of Maran a held a public hearing on the rezoning
request on February 18, 1997 and March 18, 1997, to obtain public input on the request for a change
of zoning, and heard from staff, the representative of the owner, and members of the public and has
determined that the rezoning of the property to "Zone R-8" (Single Family Residential Zone,
minimum lot size 8,000 square feet) and "Zone VC" (Villi age Commercial) should be approved, with
conditions.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Maran a,
Arizona that:

Section 1. The zoning of approximately 33.5 acres ofland located at the southeast corner of
Moore Road and Camino de Oeste, within the northwest 1/4 of the northwest 1/4 of township 11
south, range 13 east, section 31, and more particularly described in Exhibit A attached hereto, is

hereby changed from "Zone C" (Large Lot Zone, minimum lot size 25 acres) to "Zone R-8" (Single
Family Residential, minimum lot size 8,000 square feet) and "Zone VC" (Village Commercial),
subject to the following conditions:
1. The residential density of the R-8 zoned portion of the property shall not exceed four
residences per acre.
2. In the event that the VC portion of the property does not develop for commercial purposes,
the residential density allowed on the parcel shall be the same as that permitted on the R-8
portion of the site.
3. A traffic impact analysis (TIA) for the parcel will be required to be accepted by the Town
Engineer and PCDOT prior to the approval of the first preliminary plat or development plan
submitted for this project.
4. A master water plan must be accepted by the Water Utilities Director prior to the approval
of the preliminary plat by the Town Council.
5. A master sewer plan must be accepted by Pima County Wastewater Management and the
Town Engineer prior to the approval of the preliminary plat by the Town Council.
Section 2. All Marana ordinances, resolutions, or motions and parts of ordinances, resolutions,
or motions of the Council in conflict with the provisions of this ordinance are hereby repealed,
effective as of the effective date of this ordinance.
Section 3. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for
any reason held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the remaining portions thereof
PASSED AND ADOPTED by the Mayor and Council of the Town of Maran a, Arizona, this
18th day of March, 1997.
