ROOA ORDIN l"lAIL AMOUNT PAID $ 8.00 MARANA ORDINANCE NO. 97.23 AN ORDINANCE EXTENDING AND INCREASING THE CORPORATE LIMITS OF THE TOWN OF MARANA, ARIZONA, PURSUANT TO THE PROVISIONS OF TITLE 9, CHAPTER 4, ARIZONA REVISED STATUTES, AND AMENDMENTS THERETO, BY ANNEXING THERETO THAT TERRITORY KNOWN AS THE BENTA VISTA STREET/I-10 CORRIDOR ANNEXATION, WHICH IS CONTIGUOUS TO THE EXISTING TOWN LIMITS OF THE TOWN OF MARANA, ARIZONA, AND CHANGING THE ZONING OF SAID TERRITORY FROM PIMA COUNTY ZONE "RURAL HOMESTEAD (RH)" TO MARANA ZONE "RESIDENTIAL, MINIMUM LOT SIZE 144,000 SQUARE FEET (R-144)"; FROM PIMA COUNTY ZONE "RURAL RESIDENTIAL (GR-1)" TO MARANA ZONE "RESIDENTIAL, MINIMUM LOT SIZE 36,000 SQUARE FEET (R-36)"; FROM PIMA COUNTY ZONE "GENERAL BUSINESS (CB-2)" TO MARANA ZONE "VILLAGE COMMERCIAL (VC)" AND FROM PIMA COUNTY ZONE "GENERAL INDUSTRIAL (CI-2)" TO MARANA ZONE "HEAVY INDUSTRIAL (HI)." .~;a. WHEREAS, a petition in writing, accompanied by a map or plot of said real property, having been filed and presented to the Mayor and Council of the Town of Maran a, Arizona, signed by the owners of more than one-half in value of the real and personal property and more than one-half of the persons owning real and personal property that would be subject to taxation by the Town of Marana as shown by the last assessment of said property, said property is contiguous to the Town of Marana, and not now embraced within its limits, asking that the property more particularly hereinafter described be annexed to the Town of Maran a, and to extend and increase the corporate limits of the Town of Maran a so as to embrace same; and WHEREAS, the Mayor and Council of the Town of Marana, Arizona, are desirous of complying with said petition and extending and increasing the corporate limits of the Town of Maran a to include said territory; and WHEREAS, the Benta Vista Street/I-10 Corridor Annexation is an approximate 256 acre parcel located in portions of Sections 5, 6, 8 and 9 in Township 12 South, Range 12 East, Gila and Salt River Meridian, Pima County, Arizona; and WHEREAS, the petition sets forth a true and correct description of all the exterior boundaries of the entire area proposed to be annexed to the Town of Maran a and had attached thereto at all times an accurate map of the territory desired to be annexed; and WHEREAS, no alterations increasing or reducing the territory sought to be annexed have been made after the petition had been signed by any owner of real and personal property in such territory; and Marana, Arizona Ordinance No. 97.23 Page 1 of 3 10626 609 WHEREAS, ARS. ~ 9-471(L) requires the Town to adopt transitional zoning classifications which permit densities no greater than those permitted by the County before annexation; and WHEREAS, the Pima County zoning classifications on the property prior to annexation were: "Rural Homestead (RH)," "Rural Residential (GR-l)," "General Business (CB-2)" and "General Industrial (CI-2)," and the most comparable Town zoning classifications which do not permit greater densities and use are, respectively, "Residential, Minimum Lot Size 144,000 Square Feet (R-144)," "Residential, Minimum Lot Size 36,000 Square Feet (R-36)," "Village Commercial (VC)," and "Heavy Industrial (HI)"; and WHEREAS, the provisions of ARS. ~ 9-471, and amendments thereto, have been fully observed; and WHEREAS, proper and sufficient certification and proof of the foregoing facts are now on file in the office of the Town Clerk of the Town of Maran a, together with a true and correct copy of the original petition referred to herein, which is on file in the office of the county recorder. NOW THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of Maran a, Arizona, that: 1. The territory known as the Benta Vista StreetlI-lO Corridor Annexation is annexed into the Town of Maran a and that the present corporate limits are extended and increased to include the described area. 2. The zoning of said territory is hereby changed from Pima County Zones "Rural Homestead (RH)," "Rural Residential (GR-l)," "General Business (CB-2)" and "General Industrial (CI-2)," to, respectively, Marana Zones "Residential, Minimum Lot Size 144,000 Square Feet (R-144)," "Residential, Minimum Lot Size 36,000 Square Feet (R-36)," "Village Commercial (VC)," and "Heavy Industrial (HI)." 3. A copy of this Ordinance, together with an accurate map of the territory hereby annexed to the Town of Marana, certified by the Mayor of said Town, be forthwith filed and recorded in the office of the County Recorder of Pima County, Arizona.
