MARANA ORDINANCE NO. 97.28
AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF MARANA, ARIZONA,
GRANTING A SIGNIFICANT LAND USE CHANGE REQUEST SUBMITTED BY GRANITE
CONSTRUCTION FOR THE PURPOSE OF ESTABLISHING A SAND AND GRAVEL
EXTRACTION OPERATION ON PROPERTY LOCATED AT TANGERINE ROAD,
APPROXIMATELY 3/4 OF A MILE WEST OF 1-10, WITHIN A PORTION OF SECTIONS
1 AND 2 OF TOWNSHIP 12 SOUTH, RANGE 11 EAST, ASSESSOR'S PARCEL NUMBERS
215-02-0IOE, 215-02-0IOB, AND 215-01-oo5A.
WHEREAS, Granite Construction is the owner of certain property located at Tangerine
Road, approximately 3/4 of a mile west of 1-10, within a portion of Sections 1 and 2 of Township
12 South, Range 11 East, Assessor's Parcel Numbers 215-02-0IOE, 215-02-OIOB and 215-01-
oo5A, and has applied to the Town for a Significant Land Use Change in order to operate a sand
and gravel extraction on the above described property; and

WHEREAS, the Marana Planning Commission considered the application of Granite
Construction in a public hearing on July 30, 1997, and a motion to approve the Significant Land
Use Change was voted down by a 3-2 vote; and
WHEREAS, Granite Construction has appealed to the Mayor and Council, and a public
hearing was held on September 16, 1997 at which all interested parties had the opportunity to be
heard regarding the request for Significant Land Use Change submitted by Granite Construction.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of
Marana, Arizona, as follows:
Section 1. The application for a Significant Land Use Change submitted by Granite
Construction for property located at Tangerine Road, approximately 3/4 of a mile west of 1-10,
within a portion of Sections 1 and 2 of Township 12 South, Range 11 East, Assessor's Parcel
Numbers 215-02-0IOE, 215-02-0IOB and 215-01-oo5A, is hereby granted, subject to the
following conditions:
1. Granite Construction will dedicate right-of-way to the Town as determined by the
Town Engineer.
2. A 300 foot setback will be provided for any mining related activities along
Tangerine Road in coordination with that required in the approved Calmat Specific
Plan.

3. Granite Construction will coordinate main access road sharing with Calmat to
minimize transportation impacts.
4. Buffering and screening will be provided in accordance with an approved
development plan.
5. A minimum 50 foot mining setback and minimum 1 to I1h slope will be provided
next to the Tangerine landfill.
6. The greenwaste composting shall be removed from this proposal per Title 11 of the
Marana Development Code. .
7. A detailed reclamation plan shall be submitted as part of the development plan
submittal.
8. Granite Construction will work in cooperation with town staff in identifying a
taxable commodity or method of obtaining revenue from their operations.
9. Granite Construction will strongly support and cooperate with the Town in
encouraging bank protection improvements from Pima County.
Section 2. All Marana ordinances, resolutions, or motions and parts of ordinances, resolutions,
or motions of the Council in conflict with the provisions of this ordinance are hereby repealed,
effective as of the effective date of this ordinance.
Section 3. If any section, subsection, sentence, clause, phrase or portion of this ordinance is for
any reason held to be invalid or unconstitutional by the decision of any court of competent
jurisdiction, such decision shall not affect the validity of the remaining portions thereof
