AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OFMARANA, ARIZONA
READOPTING THE EXISTING REDHAWK SPECIFIC PLAN AS TO A LIMITED AREA
ONLY, AND RENAMING IT DOVE MOUNTAIN SPECIFIC PLAN II.
WHEREAS, by Marana Ordinance No. 96.46 adopted December 17, 1996, the Mayor and
Council of the Town of Maran a adopted the RedHawk Specific Plan with respect to approximately
5,570 acres; attached hereto as Exhibit A is a legal description of approximately 250 acres ("Subject
Property") which is a part of the RedHawk Specific Plan area; and
WHEREAS, a referendum petition process was commenced to cause Ordinance 96.46 to be
referred to Marana voters ("Referendum"); and

WHEREAS, the referendum was rejected by Pima County Superior Court in Alliance
Marana, et a/ vs. Groseclose, et a/., Case No. C-317744 ("Lawsuit"), and the unsuccessful parties
in such lawsuit have commenced an appeal; and
WHEREAS, the development of a high quality residential project on the Subject Property is
integrally related to the success of one or more resorts planned on adjacent property, and the
developer requires assurances that land uses and associated regulations will not be modified as a
result of any outcome of the Lawsuit or the Referendum;
WHEREAS, construction of a high quality residential project on the Subj ect Property adjacent
to the resort(s) will create positive economic benefits for the Town of Maran a, and the RedHawk
Specific Plan has many substantial benefits for the Town of Maran a including provision for school
sites, trails, park access and generally requires development to proceed in a responsible and regulated
fashion; and
WHEREAS, the development of residences on the Subject Property will permit the earlier
extension of trail access to the Tortolita Mountain Park; and
WHEREAS, the Town Council of the Town of Maran a believes that the readoption of the
RedHawk Specific Plan as it applies to the Subject Property only would be in the best interests of the
Town of Mar ana.

NOW, THEREFORE, be it ordained by the Mayor and Council of the Town of Marana,
Arizona, that:

Section 1. That certain document entitled "RedHawk Specific Plan" previously made a public record
by Marana Resolution No. 96-111. is hereby referred to and made a part hereof as if fully set out
in this Ordinance. Such RedHawk Specific Plan is hereby adopted as it applies to the Subject
Property described on the attached Exhibit A only, provided, however, that as to the Subject
Property: (i) the overall density of dwelling units permitted is reduced to 140, and the overall
maximum density under the Specific Plan is reduced by 392 units, and (ii) the specific plan is renamed
as the "Dove Mountain Specific Plan IT' and all references therein to "RedHawk" are changed to
"Dove Mountain."
Section 2. The validity and effectiveness of this Ordinance shall not be affected by any outcome of
the Lawsuit or Referendum, it being the intent ofthe Mayor and Council ofthe Town of Maran a that
this Ordinance be independent of Ordinance 96.46.
Section 3. Ifany section, subsection, sentence, clause, phrase or portion of this ordinance or any part
of the code adopted herein by this reference is for any reason held to be invalid or unconstitutional
by the decision of any court of competent jurisdiction, such decision shall not affect the validity of
the remaining portions thereof. The Mayor and Council of the Town of Marana do not by this
Ordinance repeal, cancel, amend or alter in any respect any existing ordinances, resolutions, motions
(or parts of ordinances, resolutions or motions) of the Mayor and Council of the Town of Marana
(including but not limited to the provisions of Ordinance 96.46 or Ordinance 97.32) as such
ordinances, resolutions or motions or parts of ordinances, resolutions or motions apply to any land
outside of the Subject Property described on the Attached Exhibit A.
