MARANA ORDINANCE NO. 96.07
AN ORDINANCE OF THE MAYOR AND COUNCIL OF THE TOWN OF MARANA,
ARIZONA, AMENDING THE MARANA PERSONNEL POLICIES BY ADDING A VIOLENCE
IN THE WORKPLACE POLICY STATEMENT.
WHEREAS, the Town Council did, on the 9th day of May, 1983, adopt Marana Town
Ordinance No. 83.05 providing for the establishment of the Marana Personnel Policies, and has
amended the Personnel Policies from time to time; and
WHEREAS, the Town Council has taken a strong position against violence in the workplace.
NOW, THEREFORE BE IT ORDAINED by the Mayor and Council of the Town of Marana
Arizona:
Section 1: The Marana Personnel Policies is hereby amended by adding Appendix IX as
hereinafter set forth;
VIOLENCE IN THE WORKPLACE
POLICY STATEMENT
THE TOWN OF MARANA IS COMMITTED TO PROVIDING A WORKPLACE THAT
IS SAFE FOR ALL TOWN EMPLOYEES AND IS FREE FROM THREATS, INTIMIDATION
AND VIOLENCE. THE TOWN THEREFORE MAINTAINS A POllCY THAT ANY THREATS
OR ACTS OF VIOLENCE MADE BY AN EMPLOYEE AGAINST ANOTHER PERSON'S LIFE,
HEALTH, WELL-BEING, FAMILY OR PROPERTY ARE ENTIRELY UNACCEPTABLE AND
ARE CAUSE FOR IMMEDIATE DISMISSAL. THIS POLICY HOLDS FOR ANY THREATS
MADE ON TOWN PROPERTY, AT TOWN EVENTS OR UNDER OTHER CIRCUMSTANCES
THAT MAY NEGATIVELY IMPACT THE TOWN'S ABILITY TO CONDUCT ITS BUSINESS.
SUCH ACTS OR THREATS OF VIOLENCE, WHETHER MADE DIRECTLY OR
INDIRECTLY, EXPLICITLY OR IMPLIEDLY, BY WORDS, GESTURES OR SYMBOLS,
INFRINGE UPON THE TOWN'S RIGHT OR OBLIGATION TO PROVIDE A SAFE
WORKPLACE FOR ITS EMPLOYEES.
ANY EMPLOYEE WHO BELIEVES THAT HE OR SHE HAS BEEN, IS OR MAYBE
THE TARGET OF THREATS OR ACTS OF VIOLENCE OR HAS WITNESSED OR
OTHERWISE LEARNED OF VIOLENT CONDUCT BY ANOTHER EMPLOYEE OR BY A
THIRD PARTY, SHOULD CONTACT HIS OR HER IMMEDIATE SUPERVISOR, FOLLOWING
THE CHAIN OF COMMAND IF POSSIBLE, OR THE HUMAN RESOURCES DIRECTOR

Section 2: All ordinances, resolutions, or motions and parts of ordinances, resolutions,
or motions of the council in conflict with the provisions of this ordinance are hereby repealed,
effective as of the effective date of this ordinance.

Section 3: If any section, subsection, sentence, clause, phrase or portion of this ordinance
or any part of the code adopted herein by this reference is for any reason held to be invalid or
unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect
the validity of the remaining portions thereof.
PASSED AND ADOPTED by the Mayor and Council of the Town of Marana, Arizona, this
6th day of February, 1996.
