MARANA ORDINANCE NO. 96.11
AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF MARANA, ARIZONA,
ADOPTING THAT CERTAIN DOCUMENT ENTITLED "MARANA TOWN CODE,
CHAPTER 4 POLICE DEPARTMENT", AS THE FOURTH CHAPTER OF THE OFFICIAL
TOWN CODE, ADOPTING THE RULES AND REGULATIONS THEREIN AS
CONTROLLING LAW OF THE TOWN OF MARANA, AND REPEALING ALL
RESOLUTIONS, ORDINANCES, AND RULES OF THE TOWN OF MARANA IN
CONFLICT THEREWITH.
WHEREAS, the Town of Marana wishes to establish and codify the laws of the town as
a unified code to standardize and maintain accessible, readable, and understandable rules and
procedures for the protection and security of its citizens; and
WHEREAS, that document herein referred to as "MARANA TOWN CODE, CHAPTER
4 POLICE DEPARTMENT" has been made a public record by the adoption of Resolution No.
96-17 on February 20, 1996 by the Mayor and Council of Marana; and
WHEREAS, it has been determined that the adoption of that public record herein referred
to as "MARANA TOWN CODE, CHAPTER 4 POLICE DEPARTMENT" is in the best
interests of the citizens of the Town of Marana.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Town of
Marana Arizona, as follows:
SECTION 1. That certain document entitled "MARANA TOWN CODE, CHAPTER
4 POLICE DEPARTMENT", three copies of which are on file in the office of the town clerk
of the Town of Marana, Arizona, said document having been made a public record by
Resolution No. 96-17 of the Town of Marana, Arizona, is hereby referred to and made a part
hereof as if fully set out in this ordinance and is hereby adopted as law, rules and procedures
for the Town of Marana.
SECTION 2. The various town officers and employees are authorized and directed to
perform all acts necessary or desirable to give effect to this ordinance and portion of the Town
Code.
SECTION 3. All Marana ordinances, resolutions, or motions and parts of ordinances,
resolutions, or motions of the council in conflict with the provisions of this ordinance are hereby
repealed, effective as of the effective date of this ordinance.
SECTION 4. If any section, subsection, sentence, clause, phrase or portion of this
ordinance is for any reason held to be invalid or unconstitutional by the decision of any court
of competent jurisdiction, such decision shall not affect the validity of the remaining portions
thereof.

CHAPTER 4
POLICE DEPARTMENT
Article 4-1 POLICE DEPARTMENT
Section 4-1.1 Created; Composition
There is hereby created a police department for the town which shall consist of a chief of police
and as many police officers as may from time to time be deemed necessary by the town council
for the safety and good order of the town.
Section 4-1-2 Appointment of Officers
The chief of police shall be appointed by the council upon the recommendation of the manager.
The police chief shall appoint as many police officers as may from time to time be deemed
necessary for the safety and good order of the town with the approval of the council.
Section 4.1-3 Compensation of Officers
The chief of police and the police officers of the town shall be compensated as determined by the
council. The chief of police shall not receive any perquisites, commissions or compensation for
his services as chief of police, except as the council may prescribe.
Section 4.1-4 Departmental Rules and Regulations
The police department shall be operated and managed in accordance with such departmental rules
and regulations as may from time to time be adopted by the chief of police, with the approval of the
council.
Section 4-1-5 Duties of Police Chief
A. It shall be the duty of the chief of police, to:
1. Enforce this code and the statutes of the State of Arizona within jurisdictional limits as
conferred by law and to arrest and charge the violators thereof;
2. Render such account of the police department, its duties and receipts as may be required
by the council, and Keep records of the office open to inspection by the council at any time,
except those records as may be exempted by state or federal law. Investigate or direct the
investigation of criminal acts occurring within his jurisdiction and file or supervise the filing
of necessary reports;
3. Direct traffic and ensure the orderly flow thereof and investigate and make reports of traffic
accidents;
4. Inspect and ascertain the condition of traffic control devices of every description which
have been erected within the town on the authority of the town engineer and to notify the
town engineer of any defects found therein;
5. In the absence of the clerk, collect all license fees of every nature levied within the town
and pay over to the treasurer all monies received by him, taking receipts therefor;

6. Supervise and control officers and personnel of the police department;
7. Perform such additional duties as may be required by the council or manager.
Section 4-1-6 Animal Control
The chief of police and members of the police department, in addition to their other powers, are
hereby authorized and empowered to enforce any and all rutes or regulations of the county board
of health relating to animals.
Section 4-1-7 Answering Calls Outside the Town
The members of the police department of the town are duly authorized to answer calfs for aid and
assistance beyond the corporate limits of the town pursuant to mutual aid agreements and state
statutes.
