MARANA, ARIZONA 85653 (:')20) tiR2-:i401 ORDIN 96189811 11/07/96 08:37:00 .- RD 85653 MAIL AMOUNT PAID $ 8.00 /' MARANA ORDINANCE NO. 96.23 AN ORDINANCE EXTENDING AND INCREASING THE CORPORATE LIMITS OF THE TOWN OF MARANA, ARIZONA, PURSUANT TO THE PROVISIONS OF TITLE 9, CHAPTER 4, ARIZONA REVISED STATUTES, AND AMENDMENTS THERETO, BY ANNEXING THERETO CERTAIN TERRITORY CONTIGUOUS TO THE EXISTING TOWN LIMITS OF THE TOWN OF MARANA, ARIZONA, AND CHANGING THE ZONING FROM "ZONE SR" TO "ZONE R144". ,."..-.., WHEREAS, a petition in writing, accompanied by a map or plot of said real property, having been filed and presented to the Mayor and Council of the Town of Maran a, Arizona signed by the owners of more than one-half in value of the real and personal property and more than one-half of the persons owning real and personal property that would be subject to taxation by the Town of Marana as shown by the last assessment of said property, which said property is contiguous to the Town ofMarana, and not now embraced within its limits, asking that the property more particularly hereinafter described be annexed to the Town of Maran a, and to extend and increase the corporate limits of the Town of Maran a so as to embrace same; WHEREAS, the Mayor and Council of the Town of Marana, Arizona are desirous of complying with said petition and extending and increasing the corporate limits of the Town of Marana to include said territory; WHEREAS, the petition sets forth a true and correct description of all the exterior boundaries of the entire area proposed to be annexed to the Town of Marana and had attached thereto at all times an accurate map of the territory desired to be annexed; WHEREAS, no alterations increasing or reducing the territory sought to be annexed have been made after the petition had been signed by any owner of real and personal property in such territory; WHEREAS, ARS. ~ 9-471(L) requires the Town to adopt transitional zoning classifications which permit densities no greater than those permitted by the county before annexation; p~'-"'" WHEREAS, the zoning classification on the property prior to annexation was "Zone SR" (Pima County Suburban Ranch) and the most comparable town zoning classification which does not permit greater densities and use is "Zone R144" (Residential minumum lot size 144,000 square feet); WHEREAS, the provisions of A.R.S. Section 9-471, and amendments thereto, have been fully observed; and WHEREAS, proper and sufficient certification and proof of the foregoing facts are now on file in the offic:p ofthp toum dprk ofthp Town ofM:lr;:!n;:! too-..th.... Thetenitory reflected on Exhibit "/>.:' attached hereto is annexed to the Town of Maran a and that the present corporate limits are extended and increased to include that described area. 2. That a copy of this Ordinance, together with an accurate map of the territory hereby annexed to the Town of Marana, certified by the Mayor of said Town, be forthwith filed and recorded in the office of the County Recorder of Pima County, Arizona. 3. The zoning cla!:sification of the territory reflected on Exhibit "A" is hereby changed from "Zone SR" (pima County Suburban Ranch) to "Zone R14411 (Residential, minimal lot size 144,000 square feet).
